The act protects a United States Armed Forces member who makes a "protected communication" regarding a violation of law or regulation. The superiors of these service members are prohibited from retaliating against the service member making the protected statements. The Congressional statute is implemented by Department of Defense Directive 7050.06, which protects:

(1) Any lawful communication to a member of Congress or an Inspector General.

(2) A communication which the Armed Forces’ member reasonably believes evidences a violation of law or regulation, including sexual harassment or unlawful discrimination, mismanagement, a gross waste of funds or other resources, an abuse of authority, or a substantial and specific danger to public health or safety.

But the communications must be made to one of the following:

(1) A member of Congress, an Inspector General, or a member of a Department of Defense audit, inspection, investigation, or law enforcement organization, or

(2) Any other person or organization (including any person or organization in the chain of command) designated under Component regulations or other established administrative procedures to receive such complaints.

A Court-Martial will have to be convened. Then a very corrupt and stupid JAG judge would have to be found. One willing to end his career as a judge in the military for Trump, or a huge Putin bribe. Because the trial would end after the defense lawyer introduces this act and calls for a dismissal.

And LCOL Vindman would Not have to pay for his own defense. The military would have to pay for it. And he can practically pick any JAG officer or civilian lawyer he wants, because the regs. are so lenient about selecting a defense lawyer and what lawyer would not want to play catch me if you can with corrupt Trump lawyers?

And if such a stupid and corrupt Judge does exist that would allow the trial to continue, when the case is reviewed or appealed to the Judge Advocate General it would be overturned.

Also he can't be brought before a summary court-martial (which is a single commanding officer presiding) because the scope is too far reaching and it would be overturned on review or appeal.

Trump would have to corrupt a lot of people, a chain of command, a Judge Advocate General and many in the JAG corps to do anything substantive to LCOL Vindman.

Trump was found to have exerted "unlawful command influence" in the Bergdahl case. (Of course he has also violated military integrity in other ways such as videoing special forces operatives and so much more.)

my opinion, he was murdered.
I have great difficulty finding the words to describe how bad Barr is.
Also great fear about just how far they will go. Will Hillary be locked up? Adam Schiff, Nancy Pelosi? Trump wants that. His cult at his rallies - I just finished Katy Tur's book Unbelievable. At one of his rallies someone yelled out to assassinate Hillary. They were okay with that.

My mind wanders constantly to Rwanda and how it all fell apart. It was relentless, hateful, propaganda and it whipped people into frenzied beasts. I try to attend to daily life but dread and terror are dogging me.

If Trump gets re-(s)elected I think the Tangerine Idi Amin will definitely begin public executions for those on his enemies list. Who's going to stop him? Congressional republicans and the Justice Dept. have both signaled they won't stand in his way for anything he does. The U.S.A. now has a dictator replacing a president.

So quit quoting the USC and the UCMJ and the constitution. Vindman is protected by the Whistleblow laws. Those laws also apply in the military. How many of us were told that if we see someone doing drugs--report it. The whistle blower laws are there to protect us when we report wrongdoing even by the president. Trump is eliminating this law with Barr's help (this AG really needs to be disbarred). Trump thinks he can do whatever he wants!! And apparently he can. Trump has his supporters posted all over the government, even in the OMB, Pentagon, DOJ, NSA everywhere. If they are all trump fans, they will make it happen. Stop expecting to the rules or the law or the UCMJ to apply, trump is a lawless man. The man thinks he is above the law and above the UCMJ so he can do what he want as long as the senate and the AG is there to protect him. The best they can hope for is to get vindman and his family into retirement as quickly as possible. We are in a bad, bad situation here. Is this the man we want leading our country?
