The failure of a tiny police force to investigate (the Trayvon Martin case) engendered national protests, riots, impassioned speeches by politicians and months of headline coverage.

What would the public’s reaction be if the police department in question was the largest and most powerful in the nation, the New York Police Department (NYPD)?

What if the murder was... a premeditated assassination?

What if the police not only failed to investigate, but were directly implicated in the crime and proven to have covered it up in collusion with the FBI, the New York State judiciary, and others?

What if the victim had made a video weeks before his death, exposing the corruption he had uncovered, predicting his death and naming the people he believed would kill him...?

That is precisely what appears to have happened in the case of Sun Ming “Sunny” Sheu, an anti-corruption whistleblower who was bludgeoned to death on July 26, 2010. The details of this case and the reasons you have never heard of it will be the subject of this article.

This case is a nightmare. It started when someone forged his brother's signature to get Sheu's house. He was able to prove the signature was fake in court, got a ruling in his favor, the forgers were arrested -- BUT THE MORTGAGE HOLDER CONTINUED TO ACT AS THOUGH THE SALE WAS LEGIT, THEN FILED SUIT TO FORECLOSE THE PROPERTY because the non-existent 'new owners' were in default. They wouldn't accept Sheu's payments because they said he didn't own the property.

Crooked judge ruled for the mortgage holder, ignoring the previous court ruling, the arrests, etc. WOULD NOT LET THE EVIDENCE BE PRESENTED...

Sheu made a big stink with a lot of people & corrupt judge rescinded the foreclosure, but found another way to give the property to the mortgage holder.

Sheu had fought for his house for 10 years. Then he went to the police...and they KIDNAPPED him, threatened him.

Then he went to the media...

Then he went to the FBI...asked for witness protection, didn't get it...

Sheu started investigating the judge, was told by policeman who specifically referred to information he had provided about Golia, and that if he didn’t drop it, he’d wind up dead. Sheu disregarded their warning and did wind up dead. The authorities are also refusing to honor requests for information regarding Sheu’s death made under New York’s Freedom of Information Act.

4. In a macabre epilogue, Sheu’s house – the one he had fought for over ten years to save from an

illegal foreclosure – was returned to him, with the mortgage fully paid, months after he died. According to documents obtained from the Queens County Surrogate Court [http://www.courts.state.ny.us/courts/11jd/surrogates/index.shtml], by November 2010 the home had mysteriously reverted to Sheu’s estate.

Until that time, per Golia’s order[http://sunnysheu.blogspot.com/2012/08/judge-golias-order-vacating-foreclosure.html], ownership of the home had been granted to Old Republic under the doctrine of Equitable Subrogation.

Strangely, the web site queens.blockshopper.com[http://queens.blockshopper.com/property/4054360051/14_158th] claims that the home was sold by the Qq Network Corporation [http://start.cortera.com/company/research/k3q9qyo7s/qq-network-corp/]to Sheu on May 15, 2010, but the BSN has not been able to find confirmation of this alleged transaction.

The surrogate court documents do not make it clear how the home reverted to Sheu’s estate. There is no transfer of deed recorded in the surrogate court papers. Was it simply surrendered by the bank to whom Golia gave it? Could it be that Old Republic was willing to steal a man’s home, but unwilling to be seen as the beneficiary of that man’s brutal murder?

8. The NYPD kidnapped another whistle-blower and deposited him in a mental institution.

He remained there for several days, before being released. He reported corruption within the Department, he had documented it with tape recordings, evidence that they were fixing tickets, writing down serious crimes to make it seem that crime had gone down, among other things.

He was luckier than this poor man. He survived but is no longer a cop. He is suing them, and supposedly they are 'conducting an internal investigation' which is taking an awfully long time.

What a horrible story and he took the trouble to try to protect himself. He deserves justice. But who is going to get it for him? If the police were in collusion with the FBI, where do you go next?

The whole system needs to be cleaned out. RIP Mr. Sheu. I hope they get the killers.

Sheu alerted all relevant authorities; including the police, the bank that held the mortgage, and the title insurer of the property. Eventually the parties involved in forging the documents were prosecuted, pleaded guilty to forgery, and went to jail.

18. I remember one in the 1970's where fictitious documents were alleged to have been recorded to

defraud an elderly French woman out of her property in San Francisco. When she ran out of money, she became more disheveled and was obviously not eating regularly. A number of attorneys tried to help her on a pro bono basis but she didn't speak English as her primary language, she was angry and distrustful, and it seemed that she became more agitated and confused as time went by. One attorney would be fired, and then another would take his place. Time would go by, and then the replacement attorney would be fired. It was an endless cycle. She ended up spending a lot of her time feeding the pigeons in front of City Hall where the courtrooms were located.

I also wonder how many people are engaged in fraud against elderly homeowners whose command of English is lacking by recording fraudulent documents and using the legal system to pretend that what they are doing is legal.

One of the best fraudulent schemes that I ever saw, and which is still continuing, is one involving a pre-1961 subdivision in which the developer created a man-made lake in the middle of the subdivision, conveyed easement rights to use the lake to each one of the lot owners, and then conveyed the lake to a voluntary-membership "property owners' association." In 1981, a real estate broker notarized the signatures of lot owners in two outside subdivisions by which they purportedly (1) conveyed the right to use the lake to themselves and (2) conveyed the right to participate in the association's elections. Thereafter, they fenced off the two entrances to the lake, distributed false maps which include the additional properties, and distributed false "new homeowner letters" to incoming home buyers. The false "new homeowner letters" falsely informed the incoming homeowners that the "property owners' association" was a "homeowners' association" which was entitled to collect mandatory dues from the home buyers or otherwise file liens against them. No liens have ever been filed in more than 30 years since the fraud began, although the "officers" have never been 100% successful in collecting the so-called dues. How did they and how do they get away with this? The real estate broker has become the wealthiest real estate broker in the area, and he supports the local politicians. The local politicians, in turn, control the police department which will not investigate the fraud on the so-called grounds that the disputes involving the false maps, the identity theft of the corporate owner of the lake, and the other false documents all involve a "private matter."

I would not be surprised if Mr. Sheu was told the same thing when he reported the activities to the authorities, including the FBI. I wouldn't be surprised if the law enforcement agencies told him "It's a private matter."

As Justice Joseph Golia retires from the bench after 30 years, another Golia may be starting her own career as a judge...with the dedication and enjoyment Golia has for his career, it’s no surprise that he inspired his daughter Donna to serve on the court.

Golia studied engineering and graduated from NYU in 1959, and got his J.D. from New York Law School in 1965...He eventually found a job working on the legal staff of the Hartford Insurance Group in New York from 1965 to 1968...After clerking for the New York State Supreme Court, he became a New York City Civil Court judge in 1982. He was elected to the Queens County Supreme Court about five years later and was also appointed an Associate Justice for the New York State Supreme Court, Appellate Division, in 2001. Both positions he held until his retirement.

“To be a judge is a remarkable position,” he said. “You can do a lot of good.”

Unlike the U.S. Supreme Court, judges cannot serve for life. They must retire by the end of the year of their 76th birthday. Golia just turned 74 in May, and is ending his judicial career early.

UNDISPUTED FACTS OF THE CASE

The following facts are either documented in this website or are matters of public record, and none have been disputed by any of the alleged perpetrators since the publishing of the Blackstar News articles over the past three years.


1) Sunny Sheu was the victim of an adjudicated mortgage fraud conspiracy, some the perpetrators of which were convicted.


2) Sunny Sheu was deprived of basic due process rights (discovery, deposition, counter claim, etc.) for nearly ten years by Judge Joseph Golia Queens Supreme Court.


3) Sunny Sheu was illegally detained without a warrant by DA Detectives; kidnapped in the second degree, as defined in the New York State Penal Code Section 135.20 .


4) The names of the parties that ordered and carried out the detention were illegally withheld from Mr. Sheu and are being illegally withheld from the public to this day.


5) Sunny Sheu reported alleged financial disclosure crimes by Judge Golia to the OCA Ethics Commission.


6) Captain Austin lied to the victim’s official “next of kin” regarding the cause and manner of Sheu’s death


7) NYPD officers illegally removed Sunny’s body from the hospital without legally identifying it, without a warrant, and without waiting for the next of kin to claim it.

This is just totally mind boggling what happened to this poor man. It shows blatant corruption within the NYPD, the FBI, the court systems and even the NY Senate. It's a tragedy and travesty that I hope gets exposed and properly investigated.

23. The paperwork does not match the story

First, since it's his supposed brother who owns the building, Sheu would have no legal standing in the case, one would expect his brother would be fighting this not Sheu, and how could Shue estate ever own the house after his death since it is his brothers?

Second, The supposed fraud took place in Jan 2001, yet the criminal complaint shown, which is unwitnessed so possibly never seen by a judge and possibly never further pursued, is from December 2005. The complaint is fairly basic information, and is pretty much dependent on the complainant Ming Chien Hsu, who is supposedly the brother of Shue. They knew in 2001 of the names of the supposed criminals in the fraud as these were recorded on the supposedly fraudulent sale, so why so late for a basic criminal complaint, which seems to be based solely on the complaint of his brother. Interestingly a form from the initial detective visit for a report of forgery is supplied but the full date is conveniently cut off so it is impossible to tell what year it occurred. Since the Left and right margins don't match, I would assume the last number of the year was purposefully cut off when put on the site, as it possibly would show nothing was done until mid 2005 on a supposed fraud that was harming them already in 2001. No arrest record is shown for the defendents, which shouldn't be that hard to obtain, and the earliest they could have been arrested was late 2005, I doubt any arrest were made.

Since his court case with Golia as judge started in 2001 and ended in Jan of 2005 with foreclosure, the criminal complaint from Dec 2005 could have never been used in his case because it didn't exist, yet this is the claim that Golia wouldn't let him use this info in court.

i don't really know what you're referring to. i see two documents; one's a deposition and the other is the form for the forgery report.

But I agree that the deposition doesn't constitute proof that there was a conviction or arrest. That does seems to be a pretty strong criticism.

I don't think the date of the case & the rest are so strong, though. But I would like to have evidence that the forgers were actually convicted -- without that, the rest of the story doesn't make sense.

29. The first document is a Criminal Complaint

It's the first step in criminal proceeding, the Detective puts forward the basic case, submits it to a judge who checks that the info meets probable cause and then signs it, then arrest warrants are issued. It's unsigned by the judge, so the form we see was either never seen by a judge, or was somehow copied before it went to a judge, I would go with the former.

It would be easy for anyone to get arrest and case info, since the supporters of this story don't show it, I would assume it doesn't exist.

But regardless there is no question that Shue could never have shown this Criminal complaint during the initial case before Golia, because that happened between 2001-jan 2005 and the criminal complaint happened only in Dec 2005. Also the first thing their lawyer would do after they were sued in 2001 is have them file a fraud report, which doesn't seem to have happened. Since the main claim that Golia is corrupt, is his not allowing this evidence, ie the criminal complaint, the story is ridiculous, the evidence didn't exist to show Golia.

I would say the evidence given makes me think that the initial foreclosure case was argued on different grounds, and then when they lost in Jan 2005, they appealed and decided to try and create this fraud story as a basis to nullify the foreclosure or at least drag it out.

You seem to be a clever fellow, but your assumptions and speculations are off the mark.

I apologize if there are some details and documents missing that cause you to misunderstand the case. Truthout told me to tell the story in 3,000 words and I ended up submitting 10,000. I could have easily added another 10,000 and hundreds more pages of documentation.

My co author Milton is more familiar with the details of the ownership of the home, but I believe that Sunny and his brother Hsu (not his "supposed brother&quot were co-owners of the home as members of a corporation. Hsu had power of attorney, but Sunny was still a co-owner of the house. At the time that the power of attorney was supposedly signed over to Amy Cheng by Hsu in front of a New York notary, Hsu was in Taiwan, as his passport proves.

The reason that he arrest followed the crime by several years is that the fraudsters, Amy Cheng and her partner, disappeared for this period and were arrested when they returned to New York. If you doubt that the arrest took place, please contact Detectives Ng and Lee, who Sunny was trying to subpoena to testify before Golia. It would have been quite foolish for Sunny to subpoena Ng and Lee if there had been no arrest. Sunny Sheu was one of the most intelligent men I have ever met. He attended a top school in Taiwan and spent years as a communications and computer expert in Taiwanese military intelligence. He owned two computer stores in the US, one in Moscow and one in Beijing.

My guess is the the cops were told to withhold the pertinent documentation from Sunny. Clearly some members the 109th (including the captain) were colluding with Golia.

I think you will find that the NYPD are less than forthcoming about the facts and documents regarding this case, even if you file FOIL requests and appeals, as the Blackstar News has done on several occasions.

If your point is that the article is missing some details and documentation, I apologize for the limitations of the form, but if you doubt that numerous felonies were committed by the NYPD, Golia, the New York Hospital of Queens, the Queens DA and others, then you haven't read the article carefully.

I would not at all be surprised if Lee and Ng filled this out and gave it to Sheu and never gave it to a judge at all.
There are many other facts that show that these detectives were dirty.

Perhaps Sunny was told that he these two were arrested because he had already been to Lt. Comfrey at 1 police plaza to complain about the lack of action against the forgers.

Why on earth would the cops sign this document if they didn't thane the evidence on the forgers? as a favor to Sunny Sheu?

Please enlighten us with your theories about why Sunny was deprived of all due process, why he was kidnapped by the Queens DA cops, who ordered the kidnapping, how Sunny got his head smashed in, why the ER doctor and NYPD lied about the cause of death, why the NYPD stole his body from the hospital 9 hours after his death and why the NYPD have denied all documents about the case if there was no crime?

All based on your certitude that the police report never got to Golia?

In full disclosure, your Sherlock Holmes Junior act pisses me off, because Sunny Sheu was my friend and colleague and I was the first friend to see him dead after he announce Golia's financial fraud.

Respectfully, you have no idea of what you are talking about, and obviously have no concept of the depth of corruption in New york State.

As I mentioned above, I believe the reason that Sunny needed to subpoena Ng and Lee was that the 109th would not give him documentation of the arrest, because the captain was working for Golia.

If Sunny did have the documentation, he would have faxed it to the Judge, (who would have ignored it anyway). The police report detailing the crimes of the forgers is a sworn, authentic document, and mentions forgery and other crimes specifically.

According to Sunny, the forgers pled guilty and were released with no penalties. That makes perfect sense, because had there been a trial of the forgers, or even a grand jury hearing, the whole scheme would have been exposed. "Plead guilty and we let you walk" - the perfect solution for Golia.

Milton and I are finished investigating the facts of this case, because a) we have already established proof of high crimes by many public officials, (which we can't prosecute without honest law enfacement and judiciary), and b) it's not worth getting ourselves killed at this point to find more crimes. That's the job of the FBI, who for some terrifying reason will not touch this case.

The letter to Ray kelly ( http://sunnysheu.blogspot.com/2011/06/letter-to-ny-police-commissioner.html ) alone, if it were published by the New York Times or reported on CNN, would be national news. Don;t you think a letter like that deserves a denial from Kelly, if nothing more?

BTW, it was the Blackstar News' investigation of Bernard Kerik that got him thrown in jail, so we have a pretty good record on bagging NYPD chiefs.

43. Easy to get documents

My friend,

The documents we provide prove numerous felonies by the NYPD and others.

We got them through the Medical Examiner who decide not to play along and be an accessory to murder.

The EXACT SAME documents (and many more) were denied to us by the NYPD, who in fact refused to even answer our official FOIL appeal, forcing us to sue, guess where.... in the NY Supreme Court. D'oh!

We couldn't even get the financial disclosure forms for Golia from the "Ethics commission" of the Office of Court Administration. The ONLY PURPOSE that that commission exists for is to get those forms from judges and to give them to the public. You can get the forms of any other judge in New York, but not Golia. whaddya know?

Wanna try? Its at 25 Beaver Street in New York City Just walk in and tell them that by law they must provide you those documents.

If you ever have to investigate corruption and government crimes, you will quickly find that documents have a funny way of disappearing. But by all means, request the guilty plea of the forgers. Please also find out how Bung Ha, a funeral director with no relationship to Sunny became the executor of his estate with the right to have him cremated - all with no documentation and only until the REAL executor got the estate after he was cremated. What document? Where can it be seen?

Are you aware that it is not unusual for Chinese (and perhaps other orientals) to have two names? One can be the name used in the presence of occidentals while the second name can be the family name. Sometimes they are similar. Are there two names, with one being specifically identified as the brother? Or is are there two names for the same individual?

I'm not ready to agree that he has a brother that supposedly owned the building. Where's the documentation regarding a brother relationship and building ownership?

You seem to be a clever fellow, but your assumptions and speculations are off the mark.

I apologize if there are some details and documents missing that cause you to misunderstand the case. Truthout told me to tell the story in 3,000 words and I ended up submitting 10,000. I could have easily added another 10,000 and hundreds more pages of documentation.

My co author Milton is more familiar with the details of the ownership of the home, but I believe that Sunny and his brother Hsu (not his "supposed brother&quot were co-owners of the home as members of a corporation. Hsu had power of attorney, but Sunny was still a co-owner of the house. At the time that the power of attorney was supposedly signed over to Amy Cheng by Hsu in front of a New York notary, Hsu was in Taiwan, as his passport proves.

The reason that he arrest followed the crime by several years is that the fraudsters, Amy Cheng and her partner, disappeared for this period and were arrested when they returned to New York. If you doubt that the arrest took place, please contact Detectives Ng and Lee, who Sunny was trying to subpoena to testify before Golia. It would have been quite foolish for Sunny to subpoena Ng and Lee if there had been no arrest. Sunny Sheu was one of the most intelligent men I have ever met. He attended a top school in Taiwan and spent years as a communications and computer expert in Taiwanese military intelligence. He owned two computer stores in the US, one in Moscow and one in Beijing.

My guess is the the cops were told to withhold the pertinent documentation from Sunny. Clearly some members the 109th (including the captain) were colluding with Golia.

I think you will find that the NYPD are less than forthcoming about the facts and documents regarding this case, even if you file FOIL requests and appeals, as the Blackstar News has done on several occasions.

If your point is that the article is missing some details and documentation, I apologize for the limitations of the form, but if you doubt that numerous felonies were committed by the NYPD, Golia, the New York Hospital of Queens, the Queens DA and others, then you haven't read the article carefully.
