Woman arrested for assaulting man wearing MAGA hat on Cape Cod

FALMOUTH, Mass. - A woman on Cape Cod is facing charges for assaulting a man wearing a "Make America Great Again" hat.

Rosiane Santos, 41, of Falmouth was charged with disorderly conduct and assault and battery.

Santos told police she was upset the man was wearing the hat in a Mexican restaurant.

The man wearing the hat, 23-year-old Bryton Turner of Mashpee, was so annoyed with the woman's antics that he pulled out his phone and started recording her.

The incident occurred last Friday at the "Casa Vallarta" Mexican restaurant in Falmouth.

Turner says he was minding his own business, when Santos started yelling at him because of his hat, which bears the theme that President Donald Trump campaigned on.

AFAIC, the more unwelcome people feel, wearing that stupid hat public ... the better.

Just gotta play it cool ...

I prefer the walking by and pretending to cough 'you're a dick!' approach ... then again I'm 6'5" 230lb, so I can kinda get away with a lotta shit most of the time, lol ...

"disorderly conduct and assault and battery" ... just because she snatched the MAGA hat off of a white male, sitting at a bar, and walked away?

With no blows, no threats of violence, just taken the hat and walking away?

Do you honestly think a prosecutor is going to pursue those charges, even if Maga-Boy wants to?

My bet, on all the above is NO. MAAAAAYBE disorderly conduct, with a tiny slap on the wrist, but assault and battery ... is going nowhere, is my guess.

But I suppose we'll see ... and we'll also see how much the guy wants to 'be famous'.

MAGA hat is now an emblem of discrimination against non-whites, up to and including acts of violence by the wearers. Seems to me the MAGAt was trying to incite violence in order to claim victimhood.

No, you can’t ban political slogans you don’t like, even if you really don’t like them.

From what I hear, our local community colleges offer some great introductory civics courses for adults, might be something to check out.

Freedom of speech is not absolute. MAGA hats and their wearers are notorious. Sooner or later, a defense lawyer somewhere is going to argue that an emotional, somewhat violent reaction to such a hat is not assault because of that notoriety.

The case you cite was dismissed, and Trump’s speech ruled to be protected under the First Amendment.

Freedom of speech is not absolute, but the threshold for incitement is quite high. It is not a loophole for authoritarians such as yourself to ban speech you don’t like.

The smart ass characterization comes in because it appeared from the initial clip that he walked up into the face of Phillips and scornfully grinned in a condescending manner. But that is not how it went down. His was a nervous smile, uncertain of what to do, trying to project some good will.

Is Diane Feinstein more deserving of reconsideration of an edited or truncated video than this kid?
I just don’t think it works both ways. I would like it if people could watch the whole video and tell where they see him being a smart ass. I don’t like privileged white kids wearing MAGA hato any more than you do, but we still have to treat every situation fairly.

The Black Israelites looked to be the primary instigators during the entire gathering. However, the Covington students were definitely mocking the Native Americans and the kid in no way was trying to project good will.

If the school administration was involved (not sure if they were) then I blame them for allowing the mob mentality that transpired. Not any way I would want my child to act and would hold the school responsible for allowing it. Not the action of adult leadership much less school leadership. I agree it is not a "Black or White" issue but IMO the fault lies with the nasty comments of the Black Israelites and the Catholic School kids - both were wrong and unacceptable behavior.

If there were no adults there then I say it was just dumbass kids acting like dumbass kids. But they certainly do not need any type of encouragement for such behavior. The MAGA hats, Trump sweatshirts were clearly an attempt to cause divisiveness and again not something that I would think a school would tolerate.

But this kid wasn’t. He wasn’t even paying much attention until Nathan Phillips walked up to him. And when his classmate was arguing with an NA about whose country it was, he did call over and (according to his report) was trying to tell him not to engage in a negative way.

I’m just saying that I feel that kid got unfairly characterized in a viral fashion, then mocked for trying to defend himself. I don’t appreciate his parent’s politics or choices, but I endeavor to be fair. If you saw something different, I respect that...

It isn't.

Yes, I understand that the government was not involved here, other than to respond to the bar with LE and arrest the alleged assailant for assault.

But if it's okay to assault someone because you are upset by hat he is wearing, then you can expect the same treatment in return.

Santos was arrested Tuesday near Falmouth by deportation officers with ICE’s Fugitive Operations Team, he said.

“She is presently in ICE custody and has been entered into removal proceedings before the federal immigration courts,” Mohan said in the statement.

When reached by phone Tuesday afternoon, Santos directed questions to her immigration attorney, Katarina Kozakova.

All I would have done is give a constant dirty look and make the guy uncomfortable. The times I have seen maga hat wearers I stare then down and give them major dirty looks. I made a maga once get up and leave. Another time one asked me what I was looking at and I said "not much".
