It is not up to the Courts - it is up to the Congress.

In the National Emergency Act of 1976, it says: "Congress can undo a state of emergency declaration with either a joint resolution and the President's signature, or with a veto-proof majority vote."

It should not go to the Courts unless Congress fails to do its job. That is a possibility. However, the first step lies with our Congress.
