Along with all of the other listed Mike Pence mis-steps, here's the one that Mueller has the inside track on. The transition team may have believed that their communications were protected or secret:

Trump Transition Team Discovers Mueller Has Its Emails; Complains to Congress
Trumps transition team discovers that, in September, the General Service Administration staff had complied with the FBIs August requests for copies of the emails, laptops, cell phones and other materials associated with 13 members of the team, including Michael Flynn. After learning of this GSAs actions, a lawyer for the transition team writes to the Senate Committee on Homeland Security and Governmental Affairs, and the House Committee on Oversight and Government Reform, complaining that special counsel Robert Muellers team had improperly obtained the emails.
A senior attorney at the GSA responds that, in using GSA devices, transition team members were informed that records would not be held back in any law-enforcement actions. The GSA attorney observes that the agreements applicable to the use of GSA materials during the transition provide, among other things, that that there could be monitoring and auditing of the devices, and Therefore, no expectation of privacy can be assumed.
A spokesperson for special counsel Robert Muellers office tells The New York Times, When we have obtained emails in the course of our ongoing criminal investigation, we have secured either the account owners consent or appropriate criminal process.
