(32,077 posts)Hannity's tweet does not say either #1 or #2. Why his tweet would be #3 I have no idea. I don't listen to his show so I have no idea about either #4 or #5.
A lawyer does not have to "represent in a matter" someone or get "fees" to be their lawyer for legal advice. That advice is privileged.

If a lawyer is used as a consultant they are not representing the client, hence no privilege. When Lawrence Tribe or Alan Dershowitz go on air to pontificate, there is no Privilege.
Further, Attorney-Client Privilege belongs to the client, not the attorney. If the "client" or person using their services breaks the privilege and talks about the work or the advice, that is their right and the attorney can't do it. But an attorney actually representing a client is not allowed to break the Privilege without the client's permission.

1 Says Cohen lied to a federal court about being his lawyer
2 Says any docs about him the feds seized aren't privileged
3 Makes himself a witness for Mueller
4 Revealed an undisclosed on-air conflict of interest
5 Contradicts what he said on the radio
1) Hannity said Cohen is not his lawyer. Cohen said in court (or his attorney said for him in court) that he is Hannity's lawyer. Hence Cohen lied in court.
2) Since Hannity is not a client any Hannity docs seized are not Privileged or protected. They do not need to be held back more than a fraction of a second by the Taint team checking them.
4) Hannity has reported on the Cohen stories (there are multiple stories involving him) on air and did not disclose the connection. He can't claim to be fair and balanced when he behaves like that. If he wants to pretend to be an unbiased journalist he is being unethical. (I don't watch. Only seen about 5 minutes last year. But I trust the reports on Hannity that I've read.)

(32,077 posts)A third party has nothing to do with it. If someone comes to me and says "I murdered someone, what are my options?" then the lawyer client privilege applies even though I am not representing them and there is no third party. What that person tweets is completely irrelevant.

When a person admits a crime (even falsely), automatically ACP becomes operative because a third party (the government) automatically has an interest.

Michael Cohen has never represented me in any matter. I never retained him, received an invoice, or paid legal fees. I have occasionally had brief discussions with him about legal questions about which I wanted his input and perspective.
