(52,826 posts)they dangled a possibly cooperative interview out there to avoid a subpoena for a while.
after all, why would mueller subpoena while they're negotiating a cooperative interview?
now that they feel they've played that card, they can say there are further requirements.
haven't met the "threshold".
maybe mueller will try to jump through more hoops and waste more time.
hopefully, mueller will go straight to the subpoena.
at a minimum, they successfully avoided a subpoena prior to the sotu. maybe that was all they wanted.

(71,018 posts)But BROWN goes on to say that this is "the early" part of the negotiation between MUELLER and SHITLER's lawyers for the interview, that if it gets to a stalemate, it could to the subpoena route, then possibly for a court.

.... ...President Donald Trump's attorneys are arguing that special counsel Robert Mueller's team has not met the high threshold they believe is needed to interview a president in person, according to sources familiar with the ongoing deliberations.
... the President's legal team argues that the President should not be treated like anyone else. Trump's attorneys would like Mueller's prosecutors to show that only the President can give them the information they require. The President's team, one source said, is consulting with the White House counsel's office and other outside legal experts given the implications of any decision about the President's testimony on the office of the President.
The discussions about presidential testimony are ongoing and professional, says one source. But it is now clear where the President's attorneys stand. ....
But even if the President's lawyers object and seek to fight efforts to talk to him, Mueller could ultimately seek to force the issue through a grand jury subpoena. That would prolong the issue and could lead to court battles. ....
One significant challenge facing the President's lawyers is there is no clear legal precedent for a president to avoid testifying.

(11,119 posts)Mueller will try to get Trump to come in for an interview but once Trump makes it clear that he's playing games, Mueller will send his report to Congress re: collusion, Congress will do nothing...
Then, Mueller will send the $ laundering, corruption and conspiracy cases to NY AG Schneiderman - who will file charges against Trump, Kushner and Donald Jr and use asset forfeiture to pressure them to get things resolved!
However, I thought that the practice of asset forfeiture had been rescinded by the current little POS AG of the US! Would this affect the practices of the State AGs as well?
