Follow up post from few months' ago (ref Portfolio Recovery)

I am still receiving phone calls an average of three times a week, now including threats. They don't care, they refuse to send me any information, and if I don't answer the first time they call they keep calling until I do answer. They are also "spoofing" their numbers, in an attempt to hide who they are.

This has gone on for too long.

3. I contacted my attorney general's office a few weeks ago.
They're a scam company but I'm not sure what all can really be done. The attorney general in my state sued them but lost in appellate court and are collecting info for the next go-round of lawsuits.

I'm just tired of the crap. All they want is my name, my social security number, and bank account. They really think I'm stupid.

2. Have you sent a letter yet telling them to stop calling?
A lot of people refer to a letter you want to send a FOAD letter. It stands for F off and Die. Basically you are stating that you know the letter is beyond the statute of limitations, threaten possible lawsuits if they don't stop, and tell them to cease all communication.

Send it Certified mail, return receipt requested. This will give you proof they received it, and they will know you have proof. I would expect this to have some success, if you have already done this, and they are still bugging you, you can always file a claim in court. They would be in violation of the FDCPA for not ceasing communication upon your request.

4. This was done months' ago.
I've read about this company and supposedly they are known for this crap, knowing that it can take a very long time to actually get into court. By then, they figure you'll get tired of them and deal with them on another level.

Me, I'm an admitted bitch and I don't take crap off of them. They hate me and they let me know it.

5. May I suggest a police whistle?
After you answer and they begin, blow your whistle right into the mouthpiece. They may or may not ever call back, but give them the same treatment with each call. It will discourage their calls. I used this on my obscene caller. He stopped.

7. hire a lawyer
and sue their asses! Hire a consumer lawyer in your state. They will take the case on contingency.

9. I don't think the calls will stop, according
to what I've read online about them. The caller tonight referred to me as a bitch during the call, when I asked if they had sent me a copy of the paperwork I requested from them months ago. (The paperwork in question is simply a copy of the debt. I want to know who the original debt was with, what the amount was, and when it supposedly went into default.) His comment to me was (and I quote) "That's your job to see us for that. We don't have to send you anything. I deal with bitches all the time and you're no better."

I don't think even a whistle will stop the calls. They might hang up but it won't stop them. For a few weeks I would answer the phone and lay it down, letting them talk until they realized no one was on the other line. Now it's a quick remark about how I have proof of a cease of communications letter having been received and that, unless they are calling to notify me that my debt information is in the mail I cannot continue this conversation. The person tonight broke through my quick spiel and landed that comment at me.

12. If you knew you were personally going to have your
eardrum pierced, do you think you would be the one to make that call? You have to be consistent. Every time there is a call, blow the whistle. Trust me, there will be a drawing of straws on who has to make that call.

11. My mother used to use a cap pistol.
Another friend used an air horn.

I use "get a real job, you sack of shit!" and never pick up the phone for that number again.

8. There are attorney's that love to go after debt collectors such as this. Best thing is
if they see you have a valid complaint and case, they take it on continguency as the law, at least in Michigan, is if you win the debt collector not only has to pay you a settlement but they also have to pay your attorney fees.

Check out this sites "attorney assistance" tab. It may have a listing of attorneys in your area.

Doesn't cost anything for an initial consultation(or if it does, walk away for that law firm).

10. That's one of the sites I found so much info about the company.
They really hate this company on that site. They are referred to as the "lowest of the low."

I'll have to contact someone yet again. I just don't get why they think I'm so stupid that I will gladly hand over sensitive info over the phone without any verification of who they really are and what the debt is even for.
