School district blames disabled student for own molestation
...the student's parents have sued the Santa Ana Unified School District for negligently keeping on an employee that other parents had been complaining about for years. The district's lawyers have responded by not only blaming the mentally disabled girl for her own abuse but asking that the judge dismiss the charges and make the victim's family pay the district's legal fees.

The seventeen-year-old victim, who has cerebral palsy, has the mental capacity of a seven-year-old and is confined to a wheelchair. Because she is unable to speak, no one knows exactly what was happening when another school employee found her alone in a room with Alonso Manuel Gonzalez, with her shirt pulled up and her breasts exposed, but the incident resulted in the aide's arrest for a "lewd act with dependent adult."

In a filing with the Orange County Superior Court, the attorneys claim that the wheelchair-bound girl "chose to encounter the known risk" of being alone with Gonzalez, that she "consented to" him lifting up her shirt, and that her injuries were the result of her having "failed to use due and reasonable care for her own safety and protection."

"As a grand, caring finale, the district asked presiding Judge Luis A. Rodriguez to not only dismiss all charges against them but to make the victim's family pay all legal fees," the OC Weekly concludes, adding, "Since when did the Santa Ana Unified School District take its directions toward sex abuse from the Diocese of Orange?"

1. Here are the two lawyers who claim this disabled victim consented to the sexual abuse:
Defendant attorneys Glenn Goldby and Shiao-Wen Huang weren't done. They claimed the abuse the child suffered--another school employee found the two alone in a room, with the girl's breasts exposed because Gonzalez had lifted her shirt and undershirt up to her chin while claiming to fix her shirt--was "consented to." The two also asserted the girl's parents "negligently, carelessly and recklessly supervised, monitored, controlled and instructed the minor plaintiff so as to legally cause and contribute to her injuries and damages, if any." All this about a young girl who can't verbally communicate with anyone, and thus has never been able to disclose what exactly Gonzalez did to her.

7. I see too many of this kind in court...
...the other day, one asshole said to me that he did not care if his client won or lost ~~ and this is a handicapped young adult ~~ he wanted the publicity for taking the case.

It was all I could do to refrain from kicking the asshole in the crotch. What a complete waste of a law degree. We are suppose to HELP people, not use them.

I will say, however, that I recently came into contact with a real sweetheart of an atty ~~ she took on a horrible landlord of a labor camp and did the case pro bono and then she went on her own dime to Haiti to help the earthquake victims. And...she did not look one bit of publicity. Wish they all were like her!

4. Hey, when you don't police your own...
Disbarment, ostracism, revocation of membership. These are things that lawyers and police need to use more often to improve their standing with the public. When one of your own has crossed the line and you stand up for them instead of for what is right, you only bring shame on your profession.
