As of June 1, 2008, Canadian manufacturers, importers, exporters and purchasers, who provide or distribute for sale any amount of Ammonium Nitrate (AN) in solid form (i.e. 80 percent or more of AN or 28 percent or more of nitrogen), must comply with National Resources Canada’s Restricted Components Regulations by:
• enrolling with ERD to ensure that you are listed as an authorized seller of AN
• taking security measures to protect your AN supply and all related documentation from theft and unauthorized access
• requesting from customers proper identification (e.g. government photo ID) and intent for purchasing the AN
• informing your end users and your transporters about how to protect their AN from theft
• providing the ERD Chief of Inspectors with annual inventory reports
The Explosives Regulatory Division (ERD) provides licensing services to manufacturers, importers and distributors of explosives within Canada. These licenses, certificates and permits cover a wide range of operations from the construction of complex explosive factory sites to the authorization of explosives for importation into Canada.
If you are a user of AN in solid form (i.e. 80 percent or higher AN, 28 percent or higher nitrogen), you will be asked to provide your supplier with proper identification (e.g. government photo ID) and explain how you intend to use the AN.
So, the laws are in place but they just weren’t followed. It looks like Vineland Growers' Co-Operative has some explaining to do.
