Update on home invasion shooting at Medical MJ grow

KIRKLAND, Wash. -- A spokesman for the King County Sheriff's Office says deputies found 385 marijuana plants at the home of a medical marijuana activist who was in a shootout with robbers.

Sgt. John Urquhart says investigators also found marijuana products such as butter, baked goods and paraphernalia. Deputies have no plans to arrest activist Steve Sarich but will forward their findings to the prosecutor's office.

Sarich suffered minor wounds when robbers broke into his home early Monday. One fired a shotgun at him, and pellets hit his face and arm. Sarich fired a handgun at one robber, sending him to Harborview Medical Center in intensive care.

Sarich runs CannaCare, an organization that provides marijuana plants to patients.

He said Tuesday morning that he does not flower marijuana plants at his house, but runs his grow operation like a nursery. He says many of the plants there were new cuttings and likely had not yet

If they enter the home in response to a shoot out, for example, they don't need an independent grounds for PC to arrest based on illegal activity that is in "plain sight".

A similar situation cropped up here in Michigan in which the cops responded to an open door and an alarm after an apparent attempted B&E. They happily arrested and prosecuted the homeowners for the medical marijuana grow they discovered upon entering the home.

3. to clarify, i was referring to the shooting aspect

not the MJ grow aspect.

there was a thread recently where a misinformed poster claimed that cops routintely arrested in apparent self defense shoots, and i explained that this was erroreous.

you are correct about "plain view" and "open view" doctrine case law of course

7. I had a home invasion, with four crazed handgun wielding thugs.

The sick fuck that lives two doors down, called the cops, saying I was battering a woman loudly. I have heart failure, and he wants my coughing killed. By any means necessary. So, the thugs at my door, bang and ring my bell. Tell me they are coming in no matter what. They come in, find my 18 plant med grow. On go the handcuffs. I tell them that they will take on my whole med condition, and it will be expensive. The one thug, tries to get me to spew somethjing they can bust me for. Or search more thoroughly. They said they didnt know a thing about med mar law, so I lectured them. The thug upstairs searching asks who I have in my crawlspace, I say noone, he pushes, I yell, Jimmy Hoffa. He says OK smartass, that allows me to do a better search. I plead with them not to trash the place, it's a rental. As one thug leaves, he gives me this advice. The reason they were sure I was guilty, is cuz I objected to their home invasion, and trampling my fourth amendment rights.
