I recommend the death penalty for anyone operating a motor vehicle while talking on a cell phone
Because in the past 72 hours I have had my life put in jeopardy by such persons who are totally oblivious to the universe, the safety of themselves or those around them, changing traffic lights, turn signals, the sudden appearance of off-ramps or the brake lights of those ahead of them and various and asundry other things people should pay attention to because they just had to fucking talk on the fucking phone.

131. They have been hung on trucks before...
And if you've never fired a rocket they have considerable backlash also, you really don't want to stand close behind a rocket launcher.

People have most of their ideas about this sort of thing from the movies and TV which almost always get it wrong, rockets and RPGs don't go "whoosh" when they take off, it's far closer to "WHAM!!".

133. I've fired rockets and claymores but the backblast on a claymore is a much wider
swath than that of a rocket. At least that was the case 40 years ago.

I would love to see how they mounted claymores on a truck to avoid the backblast. Any links?

127. I always thought cars should come equipped with paint ball guns
You get an allocation of five paint balls a year to mark bad drivers. I would use a couple to mark the wifes car! She was in my car a couple of days ago and I pull up behind her. She is talking on the cell phone and turns across two lanes of traffic. At least the light was green.

2. I was rear ended in September sitting at a stop light in my little car
by a truck with a guy talking on a cell phone.. He was totally oblivious to us, almost totaled that car, with my almost 80 year old mother in the car .. fortunately no one was hurt.. but YIKES! who is teaching these people to drive

4. Was it proven in court that the other driver was talking on the phone?
How does one go about that? Subpoenaing phone records, or eyewitness reports? Something else?

there were no injuries involved. He admitted fault

30. I think it was reckless endangerment..
something about being non attentive, the exact name of the charge I don't remember. When he hit us, he hit us so hard that we went into the middle of the intersection.. fortunately no cars were coming at the time. Frankly I thought he should have been hit with speeding also.. but I do not believe he got nailed with that one

33. To be honest I thought we were going to have to fight for the car repairs
but his Insurance Company called and took full responsibly.. I think they were so danged relieved that we did not sue them for costs above and beyond repairs, and car rentals..

95. So was I. The guy was looking for his cell phone, it fell.
Just can't win at this game.

I think the fines should be doubled along with the jail time for infractions where a cell phone was in use.

Would not help me, but it would be a thinking start. Similar to going past construction zones.

3. Death by pressing
for those texting while driving.
Pressing involves having a heavy door placed upon the person and the door loaded with heavy weights. The person dies of asphyxiation in about 3 days. I don't really believe in the death penalty but people putting everyone at risk because of their stupid behavior really get my dander up. And yes I have seen texting while driving more than once.

42. It's a good point, however, the phone talking does seem to be more distractive.
I used to talk on my phone in the car, but I realized it WAS more dangerous. I found that I was more likely not to notice someone moving into my lane, or such. I see drivers on their phones all the time who are driving poorly, and don't seem to be aware of that which is going on around them.

When I read the article in the New England Journal of Medicine, I decided to stop talking while driving entirely.

50. The argument I've seen about this
is that a passenger in the car is aware of driving conditions--heavy traffic, road construction, weather conditions--and is less likely to distract a driver in those conditions. I think that's a reasonable statement, since I know that I'm less likely to talk to the driver when I can see that they need to concentrate more on the road in those conditions. The onus, though, is on the driver to pay attention to their main task, which is driving.

Passive vs. Active concentration.

If you're talking with someone else in the car that person (albeit sometimes merely on a subconscious level) knows you're trying to drive and will probably lighten up on the conversation if red lights are flashing in the distance or if you're attempting to navigate onto a particularly dangerous on-ramp to a busy highway.

But if you're on a cell phone, the other person may not even know you are driving and may ratchet up the complexity, or the emotional content, of the conversation without knowing you are in a very precarious situation.

Just a guess on my part.

when i looked up i saw cars stopped in front, further back from the stop sign than normal. couldnt quite stop soon enough. little scratch on her car, none on mine, but still....

In my own experience, even the most minor of mere personal annoyances appear to be magnified tenfold when I'm driving-- everything from boom-boom "music" in the car next to me at a stop light, to my sweaty legs sticking to the seat in August.

Takes me a little while to decompress from my petulant distempers when I finally do get home on those days. :P

As a passenger, I'm not about to engage in an intense conversation with the driver when we're in the middle of bumper-to-bumper traffic, or driving on slick streets.

Within the span of two years, I was whammed twice from behind, while sitting quite legally stopped - once behind someone turning left, once at a stop sign at a busy street. Saw them both coming in the rear view mirror just before they hit me. Nothing I could do, no where to go. Both times it was a young girl driving a big SUV with a cell phone plastered to her ear.

Wish there was a law...

17. I constantly yell "GET OFF YER FUCKIN' PHONE AND DRIVE!"
Only one person noticed me so far. :) He was weaving and slowing and speeding up. He almost clipped a car and then sped up to not let a car in when the lane ended due to road work. I can almost always tell when some idiot is talking and driving. But usually it's the ones with the handheld phone with the issues.

I have no doubt it's going to come down to headsets/bluetooth for everyone some day.

if it wasn't the cell phone they'd be eating or putting on their makeup, or simply not paying attention. It's called SELF-ABSORBED. I agree with you, that anybody who has to be talking on a phone constantly, as many do, is preposterously self-absorbed. It's as if they have to have somebody "holding their hand" every minute of the day.

Also irresponsible is a statement like the subject line of the OP. Ban them from driving, fine. Death penalty? Not justified for any reason.

28. I was almost killed by a cellphone driver
It was the day before Thanksgiving 2000. I was stopped at a red light, but a woman in an Expedition was not (I had a small Escort at the time). She rear-ended me to the point where my car did not have a trunk. (the trunk was hanging on by strings until the car was repaired).

The bitch wouldn't even stay when I called the cops to report the accident. She was bitching because she was late to get her son from school. She didn't even get off the phone to apologize for destroying my car and giving me whiplash that does not go away 8 years later.

A week later NY's cellphone law went into effect.

29. I've often wonder what people did in their cars before cell phones.
Did they sit in traffic wondering whom they could be talking to? Were they counting the minutes till they got to a phone to make that all-important phone call?

I got my driver's license in 1969, and I don't ever recall wanting to talk to someone on the phone while I was driving...

and no, I'm not being sarcastic, I honestly, truly LOVE these threads. I even brought my own soapbox and everything!

Rules For When GloriaSmith Becomes Leader of the Universe:

1. When talking on a cell phone for longer than 60 seconds while driving, all four tires of the vehicle will instantly go flat.

2. Talking on a cell phone while mindlessly walking through a grocery store (or worse, stopping in the middle of the aisle so that others can't walk past you) means your grocery bill will be marked up 5x the original amount UNLESS someone approaches you, grabs the phone from your ear, and throws it to the other end of the store.

3. Restaurants. Go ahead and answer it. Just be prepared to pay the bill for EVERYONE around you. Be careful though, I have great taste in wine.

4. Movies are similar to restaurants. If you answer it, the entire theater will receive a free ticket and you will receive the bill.

5. Keeping the ridiculous ear piece on your head while not using your phone can get you ticketed by the fashion police so be careful. I'm not saying you can't wear it, but come on. It looks ridiculous.

They have to pay the grocery bill for everyone they've blocked and cut off in the store. If their yapping holds up the checkout, all the people behind them get a $150 shopping spree on their dime.

Several people here have posted about getting into accidents, not to mention near hits, involving people who choose to talk on their phones rather than drive--not really the same thing.

66. i am anti cell phone user as a whole. rarely use it. carry it in case emergency for kids
while they are at school. i dont like them

because people get distracted in all manners. cell phone is just one more way. many drive fine with them, a few dont. but then i think they probably arent good drivers anyway. many drivers without cell phone get in accidents. has been going on since cars came on the market.

because i see this on the same scale as so many other threads on du

so much demanding that all follow these narrow guide lines how we are all suppose to live

the way someone lives jeopardizes my life or my loved one's lives I'm all for guidelines. There is no doubt in my narrow mind that if the people I encountered on the road the last couple of days were not talking on the phone I would have more pad on my brakes right now and my blood pressure would be lower.

40. Bad drivers will always be bad drivers, no matter what privilege you take away.
The problem is emphasis. Some people can drive and multi-task (eating, talking, stuff like that) and still put their focus on driving. Others don't give a damn about the driving part. They focus entirely on the phone. If they weren't on the phone, they'd focus on their breakfast, their tie, the radio, or something they forgot in the back seat.

The ones I'd love to see the death penalty for are the street racers. Anyone going more then ten over the flow of traffic (not necessarily the speed limit) should be arrested and jailed, at least, and anyone racing or zig-zagging through traffic--including motorcycles--should be put out of existence before they take someone else out with them. There's a case where it's unfair to others to wait on Darwin.

Yes, people who talk on a cell phone or to a passenger are distracted and dangerous, but I'm tired of all of this Talibanesque "death penalty" crap. I think there are some people who are fine with it, but it's too easy for some to be creating a hazard just by holding the phone and driving. I'm sure there are plenty of ways to be just as dangerous (applying makeup, etc.). It's my experience that those without handsfree are the ones weaving and not signaling and such.

i laughed.

but then it also focuses and narrows the field in complex frreeway changes and routes in big cities. love it. but hard to look at that as i am watching all the traffics ect... while driving those routes

yes, i doesnt allow some stuff and has voice directing, which is cool, but i can see distraction for the stupid....

Suspension of driver's license for five years for second offense and lifetime ban for third offense should eliminate the problem provided we have strict enforcement.

The cell phone drivers are worse and more dangerous on the road than many who are driving under the influence.

And why do the cell phone drivers look at their phones when they talk? Do you think they can see the person they are talking at?

99. we watched as a female SHERIFF slammed into the back of the car next to us.
She was on the phone (we could HEAR her yelling into the phone before she hit), slammed into the car in front, which was slammed into the first car at the light, because she was going so fast.

I felt sorry enough for the guy in the middle that we stayed and gave our names as witnesses to the police that came to write up the accident.

Unbelievable how irresponsible and selfish cell phone users are. She was pissed off because she couldn't leave the scene while the cops were taking information.

... I'm usually careful to look both ways before I hit the gas. All too often I see some idiot sail right through the
intersection long after the light would have turned red in their direction. Just as if they are in a world all thier own.

How many of those conversations are NECESSARY? First off, the only conversations that should be had while driving (unless, perhaps, at speed on an empty, straight freeway like the 5) are NECESSARY ones. You're piloting a deadly projectile. You're in rapidly changing situations that demand extreme concentration.

I can't express how many near-death experiences I've had here in L.A. and how many galling near-scrapes of this sort: some ditz in an FUV (the really BIG kind, like the Chevy Suburb or the Lincoln Memorial) who's making a 9-point turn in a parking lot while gossiping about something trivial. The sheer privilege these people exude is literally deafening.

I'm in a business where I should, by definition and stereotype, be talking on the car phone, and I can at least muster a scrap of decency and responsibility to pull over if necessary.

Hang 'em high. Put 'em in a sealed room with their cell phone and have some friend call 'em and say: "Just WAIT 'til I tell you what he/she said..." and then cut the signal. Allow them to call back and just when the connection is made, hit the interference.

Someone, driving and talking on their cell phone, went through a stop sign and nearly hit me.

I was thinking, "drivers like that should get the death penalty, and email spammers should be beheaded too." Then I thought "who's next? Where will it end?" So, I decided maybe the death penalty is not such a good idea.

Steering with the hand holding the cigarette. Selfish jackasses don't care who they kill.
I got a Ford with a Sync system that is totally hands free and I still don't feel comfortable talking to someone whle driving, especially in town. I usually just wait until I'm at my destination to return a call. To my knowledge, I've never missed a call that was so critical it couldn't wait a few minutes.
