If I write in a blog that an attorney has been disbarred (true story) am I obligated to explain why he was disbarred?
The former attorney in question is claiming that a blogger friend of mine engaged in "false light defamation" because she mentioned he'd been disbarred on her blog. He claims the charges against him were bogus.
I'm no attorney but I don't see how this is a tort. He was disbarred. That is a fact.
1. Hard To See One, Ma'am: Disbarment Is a Matter Of Public Record
The disciplinary committee's view of the charges is the one that sticks. Did your friend offer this as support for some other charge against this person?
The guy was a candidate for a minor local office. Our local paper reported that he was a "disbarred attorney", without offering any of his supposedly exculpatory evidence, I might add. He lost in the primary. My pal simply mentioned his disbarment in a blog post about the general election. Now he's threatening her.
