House Passes New Surveillance Bill

WASHINGTON -- The House on Friday narrowly approved a Democratic bill that would set rules for the government's eavesdropping on phone calls and e-mails inside the United States.

The bill, approved as lawmakers departed for a two-week break, faces a veto threat from President Bush. The margin of House approval was 213 to 197, largely along party lines.

Then the House went off script. House Speaker Nancy Pelosi (D-Calif.) responded to Bush's appeal, all but calling the president a liar.

"The president says Democrats in Congress should not be deceived. They are not deceived. They know the law. They know the Constitution. We understand our responsibility to protect the American people. What the President is trying to do is something that we think should be stopped," she said, adding, "I am stating a fact. The president is wrong, and he knows it."

Democratic White House hopeful Barack Obama jumped into the fray, charging, "once again, the president is playing politics with something that should be able to get bipartisan support. There is no need to give immunity to phone companies, particularly when there hasn't been a full airing of what was done in these programs. We're not going to give a blank check to private entities who potentially are violating the privacy of their customers."

House Democrats reject telecom amnesty, warrantless surveillance

The House just now approved a new FISA bill that denies retroactive immunity to lawbreaking telecoms and which refuses to grant most of the new powers for the President to spy on Americans without warrants. It passed comfortably, by a 213-197 margin.

Notably, many of the 21 "Blue Dogs" who previously signed a letter indicating their support for telecom immunity and the Rockefeller bill -- including several of the six whom our highly successful fund-raising campaign earlier this week targeted -- voted (and spoke) in support of the House bill (only 10 Democrats voted against the bill, including at least a couple of progressives who think the bill doesn't go far enough). Many of those Blue Dogs were persuaded to support the bill by the protections which the bill offers to telecoms (i.e., authorizing them to introduce even classified evidence in the lawsuits to prove they complied with the law, if they actually did).

As impressive as the House vote itself was, more impressive still was the floor debate which preceded it. I can't recall ever watching a debate on the floor of either House of Congress that I found even remotely impressive -- until today. One Democrat after the next -- of all stripes -- delivered impassioned, defiant speeches in defense of the rule of law, oversight on presidential eavesdropping, and safeguards on government spying. They swatted away the GOP's fear-mongering claims with the dismissive contempt such tactics deserve, rejecting the principle that has predominated political debate in this country since 9/11: that the threat of the Terrorists means we must live under the rule of an omnipotent President and a dismantled constitutional framework.

It is possible that the House will ultimately end up capitulating to the President, but I have real doubts about whether that will happen. They have defied the standard GOP Terrorism-exploitation attacks for weeks, allowed the Protect America Act to expire (once the President refused to extend it), and now passed a very good bill even in the midst of intense GOP/media attacks. They did so as a result of a shrewd strategy and a willingness to frame and engage the debate aggressively. My views on the bill, and the unexpectedly commendable behavior of House Republicans, are here, from earlier in the week.

It's hard not to believe that there's not at least some significant sea change reflected by this. They have seen that they can defy the President even on matters of Terrorism, and the sky doesn't fall in on them. Quite the opposite: an outspoken opponent of telecom amnesty, warrantless eavesdropping and the Iraq War was just elected to the House from Denny Hastert's bright red district, and before that, Donna Edwards ousted long-time incumbent Al Wynn by accusing him of being excessively complicit with the Bush agenda.

9. Apparently, once they try it, they find that they like it!
I talked to my Blue Dog Dem Congresscritter at a Town Hall a few weeks ago and gave him hell about the climate crisis -- but only after thanking him for standing up with the rest of Congress to defy * over FISA a few weeks ago. He smiled and said it felt pretty good!

Why are the Democrats taking a stand now?

After dozens of opportunities to stand for what is right, the House Democrats finally take a stand? Why now, what are they after, why not before. Is it that bullshit about it being a "battle we could win" and that is why they didn't even try to stop the Patriot Act, war funding, No Child Left Behind, the Bankruptcy Bill and many other bills they should have stopped. The Democrats could have also promoted something like health care, education funding, withdraw from Iraq or other positive changes.

But they didn't!

So, send a letter with a caveat to your representative such as "I hope you will continue to stand by the American people and your constituents in the face of corporate power.

One could just as easily say that knee-jerk defeatists wouldn't know a positive step forward if it came to Sunday dinner and slapped them in the balls...becauase knee-jerk defeatists need to be righteous martyrs as they step backwards with the rest of us mediocre specimens, for that somehow feels like progress to them.

Wouldn't surprise me if it was all a dog and pony show,knowing that it is unlikely that they could muster the support for a veto override.(where are they going to find anyone on the other side of the aisle that still believes in freedom and a right to privacy?)

How can anyone NOT get the basic truth of this? That either there is no imminent terrorist threat.....or that Dubya Inc. is more concerned with the comfort of the telcos than with the lives of their fellow citizens?

20 years in telco, and I've been ashamed of the recent rollover and playing dead to the Bush administration. With all the fraud and embezzlement, moral compass being MIA, I wasn't surprised.

But today I am delighted to finally see the tide turn - perhaps our national fear of the unknown terrrorist is subsiding - and I pray for a collective return to sanity.

No more rights sacrificed in the name of democracy. No more passes for criminals and torturers.

It's NOT the American way.

I was told years ago that ALL fiber optic communication traffic was routed overseas so that "everything" was moved outside the protections of the law and Constitution and ANYTHING could be monitored. I thought the idea quite fantastic even though it came from a very reliable source that would know exactly such things. Then, the story of the fiber optic splitters hit my radar. I now see now how easily exactly that, routing ALL COMMUNICATIONS overseas, was accomplished.

Is this Bush's and the Telecom's HUGE crime hidden and covered-up behind this story?
ABSOLUTELY! That is why it is so important to the Rs!

This is such great news, and I'm thrilled that the Dems are standing up to these thugs, but something always holds me back from feeling 100% elation.

I want my country back, but somehow I feel it's not going to be fast or easy. These criminals are not going to quietly slink back under the rocks they came out of.

80. I don't know why any of our elected leaders stops short of calling the
Bush cabal liars. They should. My guess is that they are afraid of them. Since they are behaving like gangsters, it seems that they will destroy or even kill anyone who is a threat to their ambitions and criminal activities. My guess is that they know they or their families will be threatened or killed, which is why they are walking on eggs around these dangerous people. I really wish there will be a smoking gun found so hot that no one can cover up or deny it exists so that the world can rid themselves of these criminals for good.
