In 2004, Chuck Schumer Supported the Right of Bush to Use Torture at His Discretion.
If you’re wondering why Schumer is sticking with Mukasey, despite a grassroots revolt among many Democrats, it’s because Chuck is on record in support of Bush having the right to torture.

But don’t trust us.

Here’s what Schumer, himself, had to say in a 2004 Senate Judiciary Committee hearing with then Attorney General John Ashcroft:

So it's easy to sit back in the armchair and say that torture can never be used. But when you're in the foxhole, it's a very different deal.

And I respect -- I think we all respect the fact that the president's in the foxhole every day. So he can hardly be blamed for asking you or his White House counsel or the Department of Defense to figure out when it comes to torture, what the law allows and when the law allows it and what there is permission to do. http://www.washingtonpost.com/wp-dyn/articles/A25211-2004Jun8.html


Of course, the problem is that Bush picks people who will interpret to the law to allow him to torture, which the law does not allow him to do (nor does it allow him to outsource the torture to other nations). In fact, it is a war crime.

Chuck Schumer knows all this.

3. Note to the esteemed Senator Schumer: Most of what the Nazis did was "legal".
Hiding behind "legality" didn't work very well for the criminals tried at Nuremberg.

4. One problem with Schumer's reasoning
Torture doesn't work. The military no longer used it as a means of getting information until the Bush administration took over and began demanding it.

One would think Schumer knows that.

I've never been a big fan of Schumer's but tht comment on top of his vote for Mukasey makes it perfectly clear who he is. I fervently hope, that all the disgust with him, makes him at least a little uncomfortable. And i just as fervently hope that he never gets hold of that gavel he lusts after.

Those who enable and provide legal cover are just as guilty.

And not just Schumer

Congress has its share of enablers and those who helped to provide legal cover
