Did Cheney forget his claimed status when he opposed FOIAs about the Energy Task Force?
When the Sierra Club and Judicial Watch filed FOIA's seeking records from the Energy Task Force, didn't Cheney claim to be a member of the Executive Branch and oppose turning over the records?

We note only that all courts should be mindful of the burdens imposed on the Executive Branch in any future proceedings. Special considerations applicable to the President and the Vice President suggest that the courts should be sensitive to requests by the Government for interlocutory appeals to reexamine, for example, whether the statute embodies the de facto membership doctrine.

So he was executive branch then and he isn't now?

1. Okay, we're shooting craps with blank dice here, see?
But it's okay because Dick Cheney remembers where the black dots formerly were. And we can trust him.

3. this has been plaguing my mind
a court ruled using "executive privilege" to protect him .

would this new assertion have any bearing on the earlier ruling
or vice versa.

5. "That answer is now inoperative."
Remember Ron Ziegler, Nixon's last press secretary? Someone in the White House press corps asked him a question he didn't like, about something he'd said the week before. He replied, with a straight face, "that answer is now inoperative."

Sort of like the Bush aide, who told a reporter last year "You think that because you're from the reality-based community."

They're really just barking dogs, ain't they? (My apologies to dogs everywhere.)

8. Dick Cheney is a flip flopper
First he says 'go fuck youself America' by claiming "executive privilege," then he says 'go fuck youself America' by claiming he is not a member of the Executive branch.
