Summary: Cenk breaks down of infamous firefighter Frank Ricci as it relates to the Sotomayor Confirmation Hearings. When this aired live on TYT, Cenk went on to play a laughable clip of Ricci's lawyer with Megyn Kelly on Fox News bashing liberals for being mean and vicious. 3. Ricci's Bogus "Injuries"
If the lieutenant's exam was job-related, why would Frank Ricci need need to become a “virtual absentee father and husband” to prepare for it? This man has been a firefighter for seven years. Surely he was already familiar with the test material.

On the other hand, if the exam was not job-related, the City of New Haven was right to throw it out. If Ricci's “injury” consists of having to retake a flawed exam, it's trivial. The appellate court was correct in dismissing his lawsuit.

Ricci wants it both ways. He states that his “injury” was great enough to be the basis of a lawsuit, because preparation required tremendous personal sacrifice. He also claims that the exam tested knowledge of a job he's been doing for seven years. So which is it - trivial or non-trivial? It can't be both.

Actually, including time as a student firefighter, Frank Ricci has been a firefighter for 16 years, not 7. The test in question was a commonly used Civil Service test that directly relates to Firefighting. It does require extensive studying, for instance if I gave you a list of 10 chemicals could you tell me the two that would explode if allowed to mix? The New Haven board which spent 5 days reviewing the test found nothing overtly discriminatory about the test. The problem was that minorities scored at less than 80% the average of non-minorities, meeting the requirements of the EEOC that the test be reviewed for possible hidden discrimination. As Justice Kennedy pointed out, throwing out the results of the test based on performance discrepancies along racial lines is clearly illegal according to Title VII. The discrimination problem in New Haven is not primarily based in race, it's due to inherent difficulties first generation firefighters (often minorities) have in trying advance their career without the benefit of the mentoring that comes with having a father, brother, and two uncles as firefighters.

No one benefitted and no one was harmed --

and EVERYONE suffered equally -- whites, AA, Hispanics

Start over --

However, the US Supreme Court decision was an attack on Affirmative Action --
and seeks also to create racist issue where none really exists re the Ricci case.

The only racist discrimination was involved in the exam and in New Haven's prior
history vs minorities.
