1. He's saying..
..that you should not exclude LGBT's or anyone from the process...and then gets snarky as he says our justices are mostly white men...

So...anybody but a straight white male is the message here?

How about we choose someone who is "qualified"?

2. As for qualifications, you should presume that the percentage of qualified jurists
will be the same among women as among men, among non-whites as whites, and among gays as straights. The vast historical predominance of straight, white, men on the Supreme Court -- especially after women got the vote -- speaks of something other than qualifications as a reason for appointment. That can, should, and eventually will be compensated for and corrected.

8. start with qualified - then move on to making the SCOTUS a reflection of American society at least
somewhat - because having one after another WASP-male after another is embarrassing when there's so many qualified other types of background individuals out there.

Much in the same way that Obama got black support regardless of his views, from many of his race, because they wanted to see someone like them FINALLY get into a level of authority, it would be nice for GLBT people to see someone get involved at the highest levels of justice FINALLY. Just start with the qualified and let CHANGE come to our nation.

I voted for an African-American for president because of his views, not because he was black, but I appreciate the barriers broken because of the way a majority of us voted. There's nothing wrong with people who are GLBT hoping for a justice who is qualified being chosen to finally give us a 'face' on the SCOTUS. If they're liberal minded, it doesn't matter WHAT they are, once selected - we're just hoping for representation.

He wasn't SNARKY btw... that was stating fact.

That'd make hispanics, females, and lgbts happy all at the same time!

Seriously, the operative word is "OUT" LGBT jurist. We, in California, have a closeted lesbian (Justice Carol A. Corrigan) on the CA Supreme Court who has consistently voted AGAINST LGBT rights (and, hence, her own best interests), including siding AGAINST LGBT people in the historic 4-3 May 2008 decision which gave LGBTs full civil rights, marriage equality and suspect class status. With LGBTs like Carol Corrigan on the high court, the LGBT community will likely win nothing and may very well lose everything.

6. It ain't going to happen
I wouldn't oppose the move, but let's face it Obama ain't that progressive. He knows he only won the popular vote by 6% and that will be wiped clean away in 2012 if he does this. I'm not pessimistic, I'm just being realistic.

Plus, that bastard Scalia would probrably poison him/her.

7. he won the election in a huge landslide... he could do whatever he wants.
the only reason it wasn't a further landslide (as you reference 'only' 6% victory which is rather huge after the last 2 nailbiters) is because in some states there was no need to vote as you just knew Obama had won and what's the point in voting (for people who rarely vote or were really busy that day) in states like NY, CA, IL etc, and still - he won so strongly that we knew who the president was going to be when they announced Ohio for Obama around 10pm EST - that's not close and it won't be "wiped clean" because of the country hating on him because he might pick a qualified justice who happens to be lesbian.

In turn, being a lesbian or gay shouldn't disqualify them from being on Obama's own list - and I certainly hope one of the two mentioned is in his considerations. We need across the board reflection of society on the courts - and if they're qualified, who better than a female who is also gay, in the same sense a Latino would be nice.

As long as they're progressive - I'm happy!
