3. Bush doesn't care who laughs at him, if he can pull this off, he will
consider himself a huge success as a president. If this went before the SCOTUS, Roberts and his predictable group would most likely defer to the president as they have so many times before. Kennedy would very likely vote against them, another close decision though most likely imo. Roberts embraces the Unitary Executive theory as far back as when he was a clerk for Rehnquist.

this won't resolve soon.
watch but keep working people.

(the directive to Rove expired when Bush left office,
one president at a time. )

Four justices Roberts, Alito, Scalia, Thomas
must be impeached. I retain hope, but see no serious
prospect of it.

I guess the war will continue.

5. Listen folks - immunity means Rove cannot be prosecuted for
crimes he committed under the Bush administration. That does not mean he doesn't have to testify when properly subpoenaed. The "immunity" would actually free Rove to testify. He could remain silent when questioned, pleading the 5th and not be compelled to testify if he were not given the immunity (if that immunity exists).

His refusal to answer questions or appear would be a NEW CRIME, a crime under this administration. Bush cannot grant him immunity from crimes that have not occurred or that will occur under the new administration, that might occur before the new congress. If he lies or refuses to testify, if he obstructs justice, he can be charged and not a damn thing Bush could do about it.

10. Another effort to stall, keep matters tied up in new rounds of
briefs and opinion seekings, ad nauseum. Four days before he left office and not the last day- I wonder what went into his choice of timing. I'm very sure it wasn't random.
