Novak: Feds know who outed CIA agent

Robert Novak said Wednesday that special counsel Patrick Fitzgerald knows who outed a CIA agent to the Chicago Sun-Times columnist but hasn't acted on the information because Novak's source committed no crime.

Novak also hinted that he personally didn't rely on the Fifth Amendment -- which protects people from testifying against themselves -- in Fitzgerald's investigation. Fitzgerald is investigating who leaked CIA operative Valerie Plame's name to Novak and other reporters in an effort to discredit her husband, a critic of the Bush administration.

"I'm not going to tell you because it's none of your damn business," he said.

"The question is, does Mr. Fitzgerald know who the source was?" Novak asked. "Of course. He's known for years who the first source is. If he knows the source, why didn't he indict him? Because no crime was committed."

Novak said he doesn't believe his source violated laws forbidding the disclosure of a CIA agent's identity.

5. That's true ~ but Novak's source was not the leaker. His source
got the information, either directly from the leaker, or down the chain of leakers ie, Bush, Cheney, Libby, Rove, Judy Miller, Woodward, Armatage etc. If they cooperated with Fitzgerald and didn't lie, but told him who gave them the information, they would not be indicted. So, he isn't telling us anything we didn't know already.

Libby was not indicted for leaking ~ but for lying and obstruction of justice. That seems to say that Fitzgerald knows Libby himself was given the information by someone above him, ie, Cheney. Libby has already told the GJ that and went further by saying the Cheney told him Bush had authorized the leak.

The question someone should have asked Novak was 'who was the original leaker who filtered Valerie Plame's and Brewster Jenning's IDs down to your sources'? Novak already said a while ago, that Bush knew who the leaker was.
