7. Delay is leaving the state of Texas.
Moving his legal residence to Virginia;
apparently this creates a loophole that will allow
the Texas Repubs to replace him on the ballot.

Obviously he is in BIG trouble or he would not have done this after his hard fought primary run. He sees the writing on the wall and it says "cell 347"

15. Depends on state law and party rules...
and whether or not the ballots have been printed, and probably the phase of the moon. I have no idea what Texas law is, but suspect it will prove interesting.

We did go through somnething similar a whle back in Joisey when "The Torch" Torricelli stepped down from a Senate race a month or so before the election when some financial finagling was revealed.

Ol' Faithful Frank Lautenberg who had retired years earlier stepped up to the plate, sans primary but with approval from the party bosses, but there was something in state law that seemed to say you couldn't put a candidate up that close to the election. A few court battles and a lot of whining by Republicans who knew Lautenberg was a shoo-in and he stayed on the ballot. The only other possibility was no Democratic candidate in that Senate race-- something the Republican candidate would dearly have loved.

Anyway, expect some spectacular theatrics down around Sugarland as this sorts itself out. No doubt the state Republicans there have a plan, and it will be fun to watch.

But the Houston Chronicle has a Q&A about the (latest) mess that DeLay caused.

Q: How will DeLay withdraw from the November election?

A: Since he won the Republican primary in March, he cannot simply withdraw. Instead, he plans to establish residence in Virginia, which would make him ineligible for the seat. Otherwise, he only could be replaced on the ballot if he died, became too ill to serve or was convicted of a felony.....

Q: How will Republicans choose a November nominee?

A: A representative from each of the four counties that form the district will be put on a committee, which will then select a candidate.....

Q: What will become of his campaign contributions?

A: Any primary or general election money received up until the day of DeLay's resignation announcement can be used to pay for legal expenses, according to the Federal Election Commission..
