After the Clarence Thomas hearings Senator Byrd wrote, “From years of experience, I would say that we do the country a disservice by rushing any nomination, unless there is a clear record as to the nominee’s integrity, capability, and qualifications, as well as an overriding need for speedy action.” I would advance the proposition that again we are rushing this nomination. I do not see the overriding need for speedy action.
Al Gore’s allegations of the President exceeding his authority as spelled out by the constitution demands that we proceed with the utmost caution before we damage this nation beyond repair. I am concerned about the abusive use of the presidential signing statement that has become a law of the land without passage by the congress. I am concerned about the administrations advancement of the Executive Unitarian Theory. I have found nothing in the constitution to support that interpretation and believe they are making it up as they go along.
For these reasons, I believe that Mr. Alito is unfit to serve on the bench of the United States Supreme Court. I believe that unless he is truly candid with the American public on these issues he deserves to be filibustered. Our founding fathers were thoughtful enough to include checks and balances on all branches’ of government for a reason. For the Senate to abdicate their responsibility to all us of would do a dishonor upon themselves and all that came before them.

I live in Ohio, so I'm not represented by the Ohio Senators. Right now, I don't feel like anyone in the Senate represents me or listens to my views. I really hate the idea that Alito is going to be voted onto the Supreme Court without any kind of resistance from any of the Democratic Senators. I have 2 adult daughters who don't plan to have children. While most people would mourn their choice, I don't. I would mourn having grandchildren growing up in this country. What will they have to look forward to, any of the kids? And with Alito on the bench, I think what I get to look forward to is many more years of Bush as dictator, Bush's relatives as dictators, and watching them impose their will on a strangely compliant nation. If I didn't have a family who would miss me, and if I thought it would do any good as a statement, I'd set myself on fire in a public square the way the Buddhists did during Vietnam. At least in the last 6 years, I've come to understand why the Buddhists had committed suicide in such a way. They experienced the death of hope, something I never thought that I, as an American would feel.

I wrote to Sentator Clinton the other day, as I was disheartened and discouraged by the backward slide Bush is leading. I know that there isn't enough support (or knowledge of the Constitution) to keep Alito off the bench, but can't we at least try? I have learned how to become tolerant, I have lived with freedom my whole life and I've lived with hope my whole life. If you Senators and Representatives don't find the right fight to fight against convservatives, can you tell me how I can learn to narrow my mind, accept fetters and live without hope? Please oppose and filibuster against the confirmation of Judge Samuel Alito to the Supreme Court. His record has shown him to favor the corporation and government at the expense of the Constitutional rights of the individual citizen. The Supreme Court is also no place for one who espouses the "unitary executive theory" which would make the President a king or dictator. It is especially no place for Alito, who helped to pervert the "signing statement" into the abomination recently used by President Bush to reserve the power to waive restrictions on torture.

In this day of increasing abuse of executive power, as we have seen with illegal domestic spying, we need to restore our government's checks and balances, not further erode them. For quite some time, we have been traveling down the road to Fascism. If Justice O'Connor is replaced by Alito, there may be no turning back.

This is not politics as usual. It is imperative that you support a filibuster to stop this confirmation, no matter what you feel you may be "giving up" in the future by filibustering now. If Alito is confirmed, will we even have Constitutional rights worth fighting for in the future?
