14. Well we didn't know the place was repuke until this crap went down.
My Ma loves country western music and I had taken my kid to a party so we decided to go have a couple of brewskies. :toast: My Mom is blind so we had her seeing eye dog and the one she is babysitting (I call him the republican dog because his blind owner is a repuke, but I've also convinced the dog to switch parties so ) So... we go into this joint and when we get to the door, the guy with the "cowboy hat" har har har says you can't come in here with those dogs. I say, "you have to let them in, they're pilot dogs," and walk on by. Ma comes in behind me. I go to the bar for the beers and in the meantime someone offers her (ma) a table. I get the beers and sit down with them. (We are both wearing Jim Pederson shirts) Kyltheshitbag v. Pederson. We drink the first beer as I try to gag down the country honky tonk wank and ask her does she want another beer. She does. So, I go for another beer come back sit down and start to drink. The same lady that had given us the table comes up and says, "I have to ask you to leave." I asked her, "What?" thinking I misunderstood her. She repeats, "I have to ask you to leave." I say, "Why?" She says, "because there isn't room in here for the dogs." I say "Fine, but I am going to change the name of this place, Ma what do you want to call this place?" I go to the bar to close the tab and the fucking owner starts screaming at me "YOU'RE AN ASSHOLE. YOU WORK FOR THAT JIM PEDERSON DON'T CHA?" (Keep in mind, I've never seen this motherfucker in my entire life) I say, "Just what in the fuck is your beef fucker? This is a free country, so and who I fucking work for is none of your business." I get a business card from the barkeep." www.RustySpurSaloon.com Ron Peterson is the alleged owner. The lady who told us we had to leave gave us the name of Susan Anderson appeared as though she knew the whole deal was wrong, but this pig owner continued to curse so I finally get mad, "YOU FAT BRAINLESS MOTHERFUCKER, THIS REDNECK HOLE STINKS LIKE PIG SHIT AND WHAT YOU HAVE DONE IS DISCRIMINATE AGAINST A BLIND HANDICAPPED ELDERLY WOMAN WHO HAPPENS TO BE MY MOTHER YOU STUPID MOTHER FUCKER!" Then the whole place chimes in, "GET THE FUCK OUTTA HERE YOU FUCKING LIBERAL" ... blah blah blah  FUCK YOU'S were exchanged as I faced the whole fucking place down. No one got to close as the dogs are dobermans. I couldn't figure out why they let me finish my beer. So I've already called my lawyer, Jim Pederson's campaign and I'm about ready to call the KPHO. What do you think? Will my blind Ma be the proud owner of the HIPPY PALACE?

Which might be worth having if you intend to pursue this. Though they would probably cite it later as evidence of harassment.

53. Pull up a web page or any file in any program on your screen
I'm assuming you're on a PC - only because most people are. If you're on a MAc, the process is a little different, but just as easy - check the help files if so.

Just hit the Print Screen button, usually found just above the set of keys on your keyboard that includes Insert, Home, Page Up, etc. Then open any graphics app (Paint will do if you don't have anything else) and after opening a new file there, go to Edit>Paste. You should get a bitmap pic of whatever was on your screen when you hit the print screen button.

If you need more info on this, PM me. I'm signing off soon, but I'd be happy to help tomorrow if I can.

ON EDIT: I have no claim to knowing the legal value of such a thing. But I think if you seek redress for this, a polite and dispassionately accurate account of your experience submitted to the Client Stories part of their website might at least confirm your version of events in some sense, even if after the fact. You'll need smarter minds than mine to know if that opinion is really accurate.

58. One further caution
Their site may not update in (near-)real time. So if they vet the customer feedback page before updating it, your story may never appear there at all. It's a wild card, I'm afraid.

60. Worth a try
I just looked at their site and its source code again. I doubt if real-time submissions to them appear on that page without first being assessed and pasted in manually by their webmaster. It's also worth noting that most of the Patron Stories are pretty old. Given what you've said about their "hospitality", that's not surprising.

She had made a disparaging remark about short people. When she went to the local bar to interview some politician, everyone else in the place was under 5'2. They kept sending over orders to Murphy like shrimp cocktails, etc.

I think it would be great if all the blind people in your city started to hang out there (with their dogs, of course)

71. It doesn't matter.
Legally, you pretty much have to accept the claim that the dog is a service animal, because inquiring too much could violate the medical privacy of the person being served if their disability is not obvious. I had to look into this at work a few years back.

Generally you can only ask a person who has permission to be in your establishment to remove their service animal if it does something unreasonable like damage your premises or threaten somebody's safety, which is highly unlikely with a bona fide service dog.

very sweet animal. The first time I met him, she sat ON my feet and kept licking my hand and wanted to be petted. The dog had never met me before.

I am guessing they pick the dogs they train by their temperament as puppies.

One of my good college friends is blind and we were looking at apartments...we were going to be roomates. So when we go to the office the worker told us we'd have to pay a 'pet deposit' since my friend had a 'pet.' We told her it was not a 'pet' but a service animal per ADA. Back and forth we went until we decided it wasn't in our best interest to live in an apartment community with such ignorant management.

Pffft.

PS keep us posted on what happens....

Edited on Sat Oct-28-06 01:54 AM by AlienGirl
Anecdotally, parrots (my specialty) are really good at alerting their humans to things like seizures, blood sugar/pressure crises, and even panic attacks. They have feet like sphygmomanometers, can see minute changes in muscle tension, and are very attuned to their owners' state of mind. They also remain behaviorally plastic throughout life, live 40-80 years, and can talk. If I had unlimited funding and knew how to do it, I'd like to set up a program to train parrots for medical alerts, and also train them to *tell onlookers what to do*. Though some species of parrot don't like change or being in public, there are others that are attention hogs and are even-tempered enough to withstand even crowds, malls, and sports events.

Imagine an animal that alerts to a cardiac event coming up so the human can get to a safe place, then tells people in the area, "Call 911!"

66. From what I've learned of parrots over the years, this isn't unrealistic.
You should look into animal behavior specialists, particularly those who deal with birds, and find out if parrots could be a service animal. They can certainly be taught.

I would have said 'trained', but parrots, from what I've learned, are smarter than mere 'training'; they're smart enough to be taught.

A 911 crooning parrot that can detect cardiac distress or other imminent, sudden maladies could well be a very good thing for many people. You should pursue your idea. Something lifesaving could come of it- and even ONE life saved is worth all the effort.

67. There already are some service parrots, but as yet no professional school for them
I've heard of at least one African Grey with unspecified service functions, and also a conure who acted as a guide bird by ringing bells on his blind owner's shoulders to let him know which way to go and when.

There are a lot of birds in rescues (mostly cockatoos, but also some African Greys and Macaws) who are so imprinted on humans that they want to be on their human "mate" 24/7. They are called "Velcro birds." I suspect many of them would gladly be service birds in exchange for constant human contact. Everyone would come out ahead: the human would have a life-long companion to alert them to emergencies, and the bird would have the contact and intellectual stimulation of having a job to do.

As an alternative, why not get the blind folk in your area, and perhaps anyone who has a disability that requires an animal for assistance, to organize a movement against that "sterling" establishment. (Sit-ins and all that, or maybe just all showing up at once and demanding service)
It would do double duty as both a righteous stand against intolerance, and pissing off the proprietor big time.
Just a thought!

99. I think you are ignorant as to ADA law, and of pilot dogs. Pilot dogs
are allowed to stay even in hospitals with the person they guide. ADA, Adults With Disabilities Act protects the blind (protected class) from discrimination due to disability. It they are not treated like everyone else, then they are victims of discrimination. Last night was a perfect example, an ADA lawyers dream. I will let you know how I fair if you are interested, but from your comment re "babysitting a dog" I think you are blowing air.

because it's your word.

There are plenty of yes-men here who won't be honest with you, but I don't play that.

Read carefully:

You do not have the right to babysit dogs in people's bars. If you think you do, something has gone terribly wrong. And your rude arrogance in insisting to that you can take companion dogs anywhere you wish, even though they're not guiding, should be rejected outright by people who depend on, or defend, true companion rights.

I kinda doubt it, but it doesn't matter. You do not have the right to babysit a dog in somebody's bar.

You seem to be confusing dog rights with human rights. You see, it's not the dogs that have a right to enter public places; it's the people who have a right to bring the dogs into public places. You've got it backwards.

The fact of the matter is that you should have been arrested as soon as you barged into that bar. But the people there treated you with patience and respect, even in the face of your nastiness and on-the-spot blackmail.

If you need attention that bad, maybe you should find another way. What you did is like illegally parking in a handicapped space, but 5,000 times worse. It's exploitation beyond comprehension.

When you calm down, I hope you go back to that place and apologize. But I don't know how you can answer to all of the blind people who count on the rights you decided to exploit.

120. ARS 11- 1024 Section H
11-1024. Service animals; rights of individuals with disabilities; violation; classification; definitions

A. Any person or entity that operates a public place shall not discriminate against individuals with disabilities who use service animals.

B. It is not discriminatory to exclude a service animal from a public place if one or more of the following apply:

1. The animal poses a direct threat to the health or safety of others.

2. The animal fundamentally alters the nature of the public place or the goods, services or activities provided.

3. The animal poses an undue burden.

C. Public places may maintain a general no pets policy if it is not used to exclude service animals and if it does not grant rights to any person to bring the person's pet into a public place that otherwise does not permit pets.

D. A service animal handler is liable for any damage done to a public place by the service animal or service animal in training.

E. Any trainer or individual with a disability may take an animal being trained as a service animal to a public place for purposes of training it to the same extent as provided in subsections A, B and C of this section.

F. A zoo or wild animal park may prohibit a service animal, including a dog guide or service dog, from any area of the zoo or wild animal park where the service animal may come into direct contact with the animals contained in the zoo or wild animal park. Service animals shall not be excluded from public walkways or sidewalks or from any area that allows for physical barriers between the service animals, dog guides or service dogs and the animals in the zoo or wild animal park. Any zoo or wild animal park that prohibits dog guides and service dogs shall provide without cost adequate facilities for the temporary confinement of dog guides and service dogs. The facilities shall be adequate to accommodate the anticipated attendance of legally blind, deaf or physically disabled persons, shall be in an area not accessible to the general public, shall provide water for the dog guides and service dogs and shall otherwise be safe, clean and comfortable. The zoo or wild animal park on request by a legally blind person who is required to leave that person's dog guide or service dog pursuant to this subsection shall provide a sighted escort if the legally blind person is unaccompanied by a sighted person.

G. The driver of a vehicle approaching a legally blind pedestrian who is carrying a cane that is predominately white or metallic in color, who is using a service animal or who is assisted by a sighted person shall yield the right-of-way and take reasonable precautions to avoid injury to the pedestrian and the service animal. The pedestrian has the same rights as any other person whether or not the pedestrian is carrying the cane, using a service animal or being assisted by a sighted person. Drivers shall take the same precautions with respect to pedestrians who have a disability other than blindness and their service animals. A driver who violates this subsection is liable for damages for any injury caused to the pedestrian or the service animal.

H. Any person or entity that violates subsections A through G of this section is guilty of a class 2 misdemeanor.

I. This section is not intended to affect any civil remedies available for a violation of this section.

J. For the purposes of this section:

1. "Direct threat to the health or safety of others" means that a significant risk to the health or safety of others exists and cannot be eliminated by modification of policies, practices or procedures or by the provision of auxiliary aids or services.

2. "Discriminate" means discriminatory actions prescribed in section 41-1492.02 and includes:

(a) Refusing to permit an individual with a disability to enter a public place with a service animal or interfering with the individual's right to enter or use the public place.

(b) Failing to provide an individual with a disability the same services and access to the same areas of the premises as afforded to others.

(c) Attempting to impose a charge, fee or deposit because an individual with a disability is accompanied by a service animal.

(d) Requiring an individual with a disability to disclose disability related information. However, a public accommodation may ask if the animal is a service animal being used because of a disability.

(e) Requiring provision of identification for the service animal.

3. "Individual with a disability" means an individual who has a physical or mental impairment that substantially limits one or more of the major life activities of the individual.

4. "Public place" means any office or place of business or recreation to which the general public is invited, whether operated by a public or private entity and includes all forms of conveyance, including taxis, tow trucks and ambulances.

5. "Service animal" means any guide dog, signal dog or other animal individually trained to do work or perform tasks for the benefit of an individual with a disability, including guiding individuals with impaired vision, alerting individuals with impaired hearing to intruders or sounds, providing assistance in a medical crisis, pulling a wheelchair or fetching dropped items.

6. "Wild animal park" means an entity that is open to the public on a regular basis, that is licensed by the United States department of agriculture as an exhibit and that is operating primarily to conserve, propagate and exhibit wild and exotic animals.
