4. I can not describe my gratitude both for your support here as well as
for the fact that i've successfully communicated these ideas / shared them with you. Because if i did describe the tear it brought to my eyes, well then it wouldn't seem like Land Shark, would it? : )

there are around ten points or insights in this post that coulda been 10 posts, so think of it not as a somewhat longish post but as a quick way to get 10 posts all in the same place, at 2 paragraphs per post!!

14. have you written about how you came up with the name longship?
Land Shark was Twain's reference to a lawyer, and of course a SNL skit in the 70s (i discovered that after choosing the name)

My heritage is Norwegian/Finnish. I took on the Longship handle when my father (Norwegian side of the family) died about ten years ago. Kind of done to honor a very honorable man. Of course, there's the cultural connotation of the Viking funeral tradition of casting the departed off to sea on a burning longship.

My family has strong bonds to their European roots, as do many early 20th century immigrant families. It's been cultural shock moving to Southern California. Where does one go to buy lutefisk? ;-)

also made the very interesting point that convictions for conspiracy were not primarily won by the production of hard evidence but, on the contrary, by a convergence of many disparate aberrations all erring in the same direction, to the same ultimate effect (my words, not the lawyer's). Of course, the defendants' counsels will consequently seek to make an issue of hard evidence.

However when such aberrations can be quantified statistically, the 'a priori' truth, which mathematics represents, being sovereign and effectively absolute, 'odds against' an occurrence, located at an astronomical order of magnitude, can indeed be taken to the bank, in a way that Bush can only dream of; better still, perhaps, to an insurance company (or, here, best of all, to judicial proceedings). Hard evidence is more likely than not, to constitute an essentially frivolous distraction, thereby, of course, exerting an overwhelming appeal for the Defence. A more telling or indeed a more enduring "smoking gun", than inordinately massive statistical evidence, could scarcely be conceived.

The defense always asks "What is it, ladies and gentlement of the jury, about this one piece of evidence that proves conspiracy?" the answer is always nothing, because no single piece of evidence comes anywhere near.

The prosecutor looks to the totality of the evidence and says "Conspiracy is the only thing that is consistent with all of the evidence here, ladies and gentlement of the jury"

Same is true of fraud, the one proving it goes to totality, the one denying it emphasizes the alternative inferences that always exist from each INDIVIDUAL peice of evidence.
