DST saga continues...

(Indianapolis) – A vote was taken late Thursday morning on the Daylight Saving Time bill. The machine was left open for around 20 minutes, but in that time, not enough votes were cast to either defeat or pass the controversial bill.

Lawmakers voted 48-49 against the bill, but it requires 51 votes to pass or defeat it. While voting took place, the speaker of the house and his counselor appeared to be looking through the house rules, but it's unclear what they were looking for.

1. Probably determining if they could bring the bill back for another vote

Which they can because I believe it did not have 51 or more votes for or against.

The key was that the bill was not decisively defeated so it can be voted on again later.

2. Rules for Final Passage
151. Final Passage—Majority but Not a Constitutional Majority. When a bill on its final passage receives a majority of the votes cast, but not a constitutional majority, the bill shall not be considered lost. When the third reading of the bill is in order any member who voted with the majority or who did not vote at all may, by motion adopted by a majority vote, reconsider the bill; and the House shall take another vote thereon. Any number of votes may be taken in such cases
by the House.

152. Final Passage—Tie Vote. When a bill on its final passage receives the same number of votes cast against it as for it, the bill shall not be considered lost; it may, when the third reading of bills is in order, be reconsidered upon the motion of any member.

153. Final Passage—More (But Less Than 51) Votes Against Than For. When a bill on its final passage receives more votes against than for it, but less than a constitutional majority, it may be considered under the provisions of Rule 95.

154. Final Passage—51 or More Votes Against.

154.1 Whenever a bill on its passage receives fifty-one (51) votes or more against its passage, the bill, as well as the subject matter of the bill, is decisively defeated, and neither the question nor any bill, conference committee report, or amendment on the same subject matter may be considered again during the session.

However, the decisive defeat of a House bill does not prevent later consideration of or action upon a Senate bill on the same subject matter.

3. All because 13 Republicans voted against DST
If they didn't they were risking their political career with the constituents in their district.

4. Yep
it is as if these folks forgot why this has never passed in the past. Not for lack of trying, but for lack of support given that some parts of the state are tied to the other time zone (regardless of which way the statehouse tries to tie our time), and another core group of folks like things as they are. There is real political fall out likely in the house where the next election is always around the corner.
