Trick Question:
If we have three functioning branches of government, why does the President get to announce who will be prosecuted and who won't??

You DO remember we have a Judiciary, Right??

Staying out of the fray does not override the law or the Constitution.

1. Umm...in most cases the US Attorneys bring federal charges
And they work for the AG, who works for the President.

7. The Judicial Branch of our government is the courthouses, judges, clerks, etc
They provide a venue for legal proceedings.

And, thanks to Marbury , they also provide judicial review on the legality/constitutionality of various topics.




The Solicitor General works for the Attorney General at the US Department of Justice. The Attorney General is an Executive Branch Cabinet-level position.


The 93 US Attorneys (Federal Prosecutors) also work for the Attorney General.




So to answer your question, yes, the Judicial Branch and the Executive Branch are separate entities. But the DOJ does not work for the Judicial Branch.

or at least, it is supposed to.

Holder will make the case that the Justice Department needs to be above reproach in terms of being politicized, a nod to the era of Gonzales, who resigned after accusations that the department had improperly fired at least nine U.S. attorneys for political reasons, as well as allowed politically biased hiring practices to take hold within the department.

Holder noted in his testimony that he will work to restore the credibility of the Justice Department…
