Burris' actual IL Supreme Court filings in Burris, et al v. White
The papers are in .pdf format an are on the Illinois Supreme Court's website.

He makes a good case, folks; seems pretty certain that Sec. White's going to lose and will be forced to convey the certified nomination to the US Senate.

2. You may be right.
I dislike Blagojevich about as much as the next guy, but I'll concede that he's not been convicted of anything. I believe that he does have the right to fill the vacancy under Illinois' law and that he has done so properly.

Why are Sec. White and Sen. Reid picking fights that they're both almost certain to lose?

4. Because they're Dems, and with the GOP propaganda machine
going full blast 24/7, it's much easier to fire on other Dems than to take on the real enemy, which is the corrupt, malignant Republican party.

6. Either we're a nation of laws or we're not. I dislike Blago as much as the next guy,
but I'm damn fond of both the state and US Constitutions. So, Blago gets to name the senator. Case closed.

8. I'm not admitted to practice in Illinois, but that looked pretty good to me.
What surprises me is that Obama surely knew what Blago is like--a cunning, unpredictable egotist with no shame.

Despite knowledge of Blago's character, Obama somehow thought that he could get Blago to heel.

It looks like a complete miscalculation.

I just hope that Burris' vote is not needed for cloture for any important legislation.

I'd hate to delay the stimulus package on what looks like a pissing contest between Obama (or Emanuel) and Blago. Too much is at stake.

10. I clerked for Justice Shapiro years ago, and it looks like a slam dunk.
I've only seen one mandamus action, but this one looks like a sure-fire winner. I don't envy Attorney General Madigan her job defending Sec. White on this.

15. Any delay by Madigan will look political, just like Sec. White.
Harry Reid just looks ridiculous getting involved in this stuff.

11. The AGs office apparently has until Jan 11 to respond.
Which gives the dems plenty of time to refer this to the rules committee.

13. The news here says the hearing is on Monday.
According to the local TV station, the expedited hearing on Burris' motion is set for Monday.

last update I can find shows Burris asking for an expedited hearing, cnn just reported the SOS doesnt have to respond until weds.

16. Maybe this explains the discrepancy
sec. White has until Wednesday to respond unless the Court grants Burris' motion for an expedited hearing. Sorta makes all the pieces fit into the same picture.
