Kucinich files lawsuit after party denies him place on ballot

AUSTIN—Democratic presidential candidate Dennis Kucinich, along with supporter Willie Nelson, have filed a lawsuit to get Kucinich on the ballot in Texas after they say the Texas Democratic Party rejected his application.

The civil lawsuit was delivered late Wednesday afternoon to U.S. District Court for the Western District of the United States, Kucinich spokesman Andy Juniewicz said late Wednesday evening.

The lawsuit says that Kucinich was informed by the Texas Democratic Party on Wednesday that his application was "defective" because he crossed out a loyalty oath in the application that said he would swear to support whoever the Democratic nominee for president might be.

The lawsuit asks that a temporary restraining order be issued to stop the Texas Democratic Party from certifying to the Texas Secretary of State a list of candidates and to restrict the secretary of state from accepting any list that doesn't include the name of a qualified candidate who refuses the loyalty oath.

Kucinich, a congressman from Ohio, also wants the court to declare that the oath requirement violates the First Amendment and the 14th Amendment in the Constitution.

"He's right to challenge a blind loyalty oath to the Democratic Party because it's un-American," Willie Nelson said in a news release from the Kucinich campaign.

Calls for comment made to the Texas Democratic Party and the secretary of state's office after business hours on Wednesday

1. I admire the heck out of Dennis Kucinich
I have no idea of the legal merits of this case but Dennis Kucinich is a man of conviction and that is something I respect.

4. Texas was an independent country before joining the US....
you can only give California, Nevada, Utah, Arizona and parts of New Mexico, Colorado and Wyoming back to Mexico since that was what the US "won" from the 1848 US-Mexican war.

You can't give back what you didn't win.

5. I really wonder about Dennis...
again and again he refuses to comply with the smallest requirements that all other candidates accept as a matter of course. If you want to be on the ballot in Texas, you must sign a loyalty oath to the party to support the party's eventual nominee.

This is just Dennis on the outside looking in and saying "they continue to ignore me."

Repugs in Texas have had a way of becoming Dems long enough to take over a Dem district. They solved this problem after Tom DeLay gerrymandered Texas so that all districts are Repugnant.

That is why the oath is on the ballot inclusion application.

Dennis appears to be a certifiable nut.

6. its the only way he gets Media Attention
when he cries and whines.the media reports it....he thinks it makes him look real big and important...to me he acts like a whine ass baby..guess the rules were made for other people not him.....or so he thinks!
