Where is the brave judge that will subpoena spy records ??

Where is the brave judge that will subpoena spy records ??
Because no man is above the law. Not the Dictator. Not the Pope. Not the President. The rights of the people in a democracy supersede any claim of "inherent" authority by any leader. The people have a right to know if they have been spied upon illegally. It would be good to see a judge request a freeze on all the records until they can be analyzed by authorized people in the House and Senate. Don't even think of destroying any records, the judge should say.

2. It ain't gonna happen. Bush's position is these decision are unreviewable
even if there were a subpoena he wouldn't comply. Bush has declared that he has been given an Enabling Act to suspend traditional checks and balances between the executive and the other 2 branches of government.

What must be pursued is remedies that do not require the executive branch's cooperation. I think the available, legal, remedies are quite limited, indeed I think they boil down to just one. A trial in the senate.

3. It will be the judge that the congress requests the subpoenas
from, or in the case of a special/independent prosecutor the one he/she sends the request to.
