'Stacks of papers' support indictment, foreman says; DeLay says there's no case

AUSTIN – Grand jurors were presented a load of evidence, including testimony and phone records, that led them to believe Rep. Tom DeLay should be tried on a conspiracy charge, the leader of the Travis County grand jury that indicted the congressman said Friday.

"It was not one of those sugarcoated deals that we handed to Ronnie Earle," William M. Gibson said.

He added: "Mr. Earle has stacks and stacks of papers – evidence of telephone calls from Mr. DeLay and everybody."

Mr. DeLay has said that Mr. Earle has no evidence to prove that he tried to subvert Texas election laws. The Sugar Land Republican's lawyers did not return calls seeking comments on Mr. Gibson's description of the grand jury proceedings.

3. I believe this is true. The other day, Molly Ivans was on CNN
arguing with some Pub DeLay supporter about Earl being on a witch hunt and the case would be thrown out just like the Hutchinson case was. Molly said "Ronnie Earl's been through this before, and there's no way he would let that happen to HIM again!"

I believe that!

I also don't really care if Earl was on a with hunt or not. If he has to evidence to prove charges against DeLay, it doesn't matter!

4. The perception that "The Hammer" is "bulletproof"...
NO ONE is going to waste their time going after DeLay unless they have hard evidence, and plenty of it.

It will be interesting to see what happens next week with Fitzgerald and the Plame investigation. On the cable news shows last night, Judy Miller's testimony was referred to as "the last piece of the puzzle" (whether that is accurate or not) and the pundits were split on whether there would be indictments. No one wanted to go out on a limb and make that prediction.

But when it comes to DeLay, I'm sure that Earle anticipated all kinds of fireworks from DeLay and his supporters...WHY would he waste his time going after him if he was playing an empty hand?
