Councilman says Florida gun permits are on their way out in Philly

Philadelphia police soon may be enforcing a city ordinance that closes a regulatory loophole allowing more people to carry concealed weapons in the city.

Philadelphia police are notoriously strict about issuing gun-carry permits, often turning down applicants who might get approved in other states. City Councilman Darrell Clarke introduced a bill addressing the issue last year because he said too many Philadelphians are carrying firearms with permits from down South.

"The reality is that you can carry a weapon in the state of Pennsylvania if you simply go online and get a permit to carry from the state of Florida," Clarke said in a telephone interview. "There have been several documented incidents where individuals who have Florida permits have actually committed crimes."

In February, City Council passed Clarke's bill closing the "Florida loophole" in Philadelphia, but enforcement has been put on hold until legal questions are resolved.

6. Seems as though the bill that the City Council
passed has one little problem according to the comments on the linked article. It's against Pennsylvania Statutes. Why didn't you mention that in the OP?

Under Pennsylvania law....He completely LACKS THE AUTHORITY TO DO ANYTHING...

Only the state has that authority. And some lawyer will teach them this, in a very expensive to Philly taxpayers way.

Just for the record, my company does lots of work in Philly... Virginia and Pennsylvania has recipocity with their CCW permits... They mess with me over my completly legal, and carried .45

...I will sue...

And like several before me, I will win.

PA has a state premption law. It has been tested and won, in court.

Philly KNOWS this.


Do you approve of them wasting taxpayer dollars, passing illegal laws, and opening themselves up to lawsuit which costs the taxpayer yet more money, jpak?

11. You should have to be a resident of a state
to get a permit from that state, and abide the rules and regulations of that state. Makes sense. Can you be a resident of one state and get a driver's license from another state?

Pennsylvania has state preemption laws, and the city of Philadelphia has already lost in court several times over this very issue.

Court cases, won or lost, are how we define the law.

So now you're encourageing disobeying the law if you don't agree with it? Or is it just OK to ignore the law if you are "The State"?

We call that fascism where I come from but it was a very popular technique for your hero George Wallace and his buddies. So I can see why you'd think it's a smart thing to do. Because after all, the government knows what's best for you.

Laws are not the result of some asswipe -- who struts down peaceful, public streets openly carrying a gun -- "winning" a court case. Hope lawmakers do not bend over to pressure of those who can't be without their friggin guns when going to places families gather.

Ummm, that's exactly what they are. When the court rules against the legislature that becomes the law, see Heller, McDonald etc.

You may not like it, but too damn bad. Feel free to piss and moan as much as you'd like but don't expect anyone to enforce your version anytome soon. It's the law until the legislative body changes it and the courts uphold it.

As much as we all know you'd prefer a "benevolent despotism" running things, with like minded despots in charge, we do still have to abide by the laws that exost, not the ones in your fantasy land.

Now try and stop embarassing yourself with such drivel and demanding that every thread be somehow about concealed carry.

Once upon a time, they didn't want "those people" carrying guns.

Now, they don't want "those people" carrying guns.


So to answer your question, yes, things HAVE changed:

The definition of "those people" was changed from "people of color" to "people from other states".

"They still don't want friggin guns."

You could just try stating it honestly:

They don't want OTHER PEOPLE carrying guns.

If "they don't want friggen guns", nobody is going to force them to own, touch, or possess one.

This is about controlling others, plain and simple.

16. No matter how much the city councilmen and mayor of Philadelphia squirm...
they can't get out from under the fact that they are fuckwits who have no authority in this regard.

The Commonwealth of Pennsylvania has pre-empted this power for themselves, and the Commonwealth allows it's citizens - even those in Philadelphia - to carry concealed firearms under other states' Concealed Handgun Licences (provided that state has a reciprocity agreement in place).

Until the state law is changed, Philly is going to keep getting their balls kicked-in by the courts on this subject.
