BSO: Black driver shot 2 in self-defense (FL)
http://www.miamiherald.com/466/story/349532.html

With one wielding a knife, two men pounded on Hygens Labidou's roofing truck and shouted racial epithets, authorities said.

''N-----, get out of the truck!'' they allegedly snarled, according to a copy of a 911 tape released Tuesday. One of the men, six feet tall and 350 pounds, tried to pull Labidou from the truck.

Moments later, Labidou, fearing for his life, pulled out his 9mm semiautomatic gun and fired, wounding the two Cooper City men -- one fatally -- in the middle of a busy Deerfield Beach intersection.

Labidou, 49, of Wellington, will not be charged because he acted in self-defense, the Broward Sheriff's Office said.

''These two men approached him with a deadly weapon in an aggressive manner,'' BSO spokesman Mike Jachles said. ``Clearly, he was inside his vehicle, and he was clearly within his right to defend himself.''

2. felony murder
I'm glad to see

"The surviving suspect, Steven V. Lonzisero, will be charged with felony murder in the death of his alleged accomplice."

It's nice to see that Hygens Labidou won't have the additional stress or expense of defending himself in court for his actions. This is due to the changes in the "castle" (or in this case vehicle) laws.

Here in Illinois, just having a functional firearm in your vehicle would be "unlawful use of a deadly weapon" which is a felony.

3. Well of course the real answer...
....is he should have politely asked the hulking KKK guy and his buddy who wanted to rip him bodily from his vehicle to desist, since there is no need to use any kind of force in self defense.

It's strange when we have to look to Florida for legal sanity....

6. some are busy
<sarcasm>Since they can't harp that Borowsky committed suicide, they're hastily gathering whatever they can to discredit Labidou. So far, blonde/single/fired from a LEO job are off the table, but you can bet they'll come up with something to paint him as a cold-blooded murder. They're probably looking for records of him serving in Iraq or digging through his trash for an NRA brochure.

"Maybe the deceased knew too much, did the cops look in Labidou's trunk for a dead body?"

Go ahead, laugh sneer etc, you know and I know that worse has been posted in GD over the years. ;)

9. Here is another article with a little more detail
http://www.sun-sentinel.com/news/local/broward/sfl-flbroadrage1220sbdec20,0,4007170.story

In Lonzisero's quiet Cooper City neighborhood, a young man described Lonzisero as a "hothead." A woman said Lonzisero moved in about a year ago and quickly got into a dispute with another neighbor who was walking dogs in front of his yard. Lonzisero cursed as he asked her to take the dogs away, the neighbor said.

In 1999 in federal court in New York, Lonzisero pleaded guilty to one count of conspiracy to commit murder in furtherance of racketeering activity and one count of unlawfully taking a motor truck in an interstate shipment case, according to court records. He was sentenced to 18 months in prison, followed by three years of federal probation, which was transferred to South Florida in April 2001.

In June 2005, Lonzisero was sentenced to time served, a year of house arrest and two years of federal probation for possessing and affecting commerce in firearms. Lonzisero had four pistols and two silencers, and federal authorities said he drove from Cooper City to Queens, planning to commit a home invasion robbery against people he knew, according to Newsday.

In June, Lonzisero's attorney wrote to a federal judge in New York noting that Lonzisero had just begun serving his year of house arrest. The lawyer, Michael Schneider, declined to comment on Wednesday but in the letter he asked that Lonzisero, who he said ran a "tractor-trailer demolition business" in Cooper City, be allowed to bid on and travel to out-of-town jobs. Lonzisero was allowed to leave his house to work.

Sound like nice guys. Hope Labidou won't have to fear for his life in the form of vengeance from friends and family.

14. WTF????
In 1999 in federal court in New York, Lonzisero pleaded guilty to one count of conspiracy to commit murder in furtherance of racketeering activity and one count of unlawfully taking a motor truck in an interstate shipment case, according to court records. He was sentenced to 18 months in prison...

OK, run the numbers. He had already been convicted of conspiracy to commit murder, two counts of felon in possession of a firearm, two counts of possession of a firearm sound suppressor (10-year felony EACH), and was last seen planning to commit an armed home invasion robbery (the most dangerous kind), and he's under "house arrest", apparently loosely supervised so he can go around committing more robberies?

:wtf:

What, were the prisons so full of eeeee-villlll dangerous terrorist pot smokers that they couldn't put this guy behind bars? Maybe they should have let a pot smoker go and jailed this guy instead, ya think?

11. Well, you pays...
Well, you pays your money and you takes your chances. Crime is a risky occupation
with a very high rate of attrition. And eventually the criminal will meet someone
more motivated to survive than themselves, as these two clods did.
