Wesley Baker, black, is scheduled to be executed in Maryland during the week beginning 5 December 2005, for the 1991 murder of a white woman, Jane Frances Tyson.

Doubts have been raised about whether Wesley Baker was the actual gunman.

In denying Baker’s appeal in July 2000, the Fourth Circuit Court of Appeals admitted that ''the evidence that Baker shot Tyson was not overwhelming''. The United Nations Safeguards Guaranteeing Protection of the Rights of Those Facing the Death Penalty state that ''capital punishment may only be imposed when the guilt of the person charged is based upon clear and convincing evidence leaving no room for an alternative explanation of the facts.''

Despite being aware that it would aid in his defense, Mr Baker would not allow the traumatizing circumstances of his life to be applied to his defense, because he would not allow his mother to be subjected to the humiliation.

If so, then ......the jury of his peers have spoken. I realize that the death penalty does not serve as a deterrent to crime....but the State which allows it has made its decision to exercise their law and to carry out the sentence to execute. This is a grassroots issue where the laws need to change banning the death penalty. At present, it's a go in Maryland.
