They are offering to pay for six of those months.

Why are you being terminated and why would you sue?

I've had a job where I'd never have ever taken that offer: they wanted me gone and if my contract wasn't almost up they'd have looked for a reason to terminate. They were crooks and the executive director sexually-harassed me for months...I wanted a reason to sue.

My current job...I'd take that offer. If I were terminated from my current position, it'd be my own fault. I'm on probation as-is because I'm not very good at my job. (I cash-handle and I'm first in my district in large-variance cash discrepancy) I can't see any reason I'd sue; frankly I'm shocked I haven't been fired yet. They're only out about $2K on me this year alone.

8. The termination is because of the end of a project.
I expect to receive favorable recommendations
from former supervisors and co-workers.

it sounds very reasonable. Not sure why a suit is even being discussed in this situation. :shrug:

Any chance you could negotiate with them to pay for more than 6 months of your COBRA?

11. I know a little about this because I'm counselor at a college and
I hear a lot about these kinds of situations. It completely depends on your grounds to sue. I'd definitely talk to an attorney to see if you have a case. If you do, I sure wouldn't sign those papers. Corporations are screwing people like I personally have never seen (where I work and where so many of my friends work - for big companies). Often times when people just threaten to sue (and there could possibly be a real case) the corporations will make an out of court settlement because it costs them less than legal fees and the pain in the ass it is (for them). It's really important that you get a lawyer's opinion (I'd made sure it was someone who specializes in this area).

7. Depends on what lawsuit I might be entitled to/deserving of.
Also, if I were giving up any other rights. Otherwise, probably. COBRA is expensive.

wondering what part of the picture I was missing. Is there any reason for them to think you might sue? For what? Or is it some kind of standard parting "gift" to have ex-employees sign?

19. Here's the deal
these days, it's really easy to get a settlement if you bring a case against an employer. Because of the tenor of the times, no one dares risk a jury trial , even in the case of a justifiable termination.

So they settle. Always. Without even blinking.

Rather than lose that issue they secure a promise from you not to sue.

Which, by the way, actually doesn't preclude you from suing, but if they win they would expect you to pay back the COBRA they paid.

So it's kinda standard these days to ask for a waiver of rights

15. Yes, unless I had a good suit that would pay out more than the six
months of COBRA. And no lawsuit is very certain. So you'd have to believe in that lawsuit.
