Couple demands $1 million from Home Depot for damaged love life
ATLANTA AP — A couple is suing Home Depot and the manufacturers of a grout sealing product for $111 million — including a $1 million claim that the product destroyed their sex life.

Jay Flynn and his wife Laura, who live in Georgia, said that he became ill and was hospitalized for four days after using an allegedly defective batch of Tile Perfect Stand'N Seal Grout Sealer in July 2005.

According to the lawsuit, doctors told Flynn his lungs were permanently damaged by fumes from the product, which left him with only half his normal breathing capacity.

As a result, Flynn had to quit his job as a product manager and stop coaching his son's baseball team. In addition, his "once active" love life has suffered.

1. Sounds familiar
Myself along with my car insurance company was sued by a woman who was in a car wreck with me. Her and her husband tried to sue saying they couldn't easily produce a larger family as planned because she had a bad back because of the wreck. They said having sex was out of the question and they want $$$$$$$ for their trouble. Judge laughed them out of the court room.

2. It's common in personal injury lawsuits
It's called "loss of consortium". How would you like your sex life forever altered because someone else sold you a defective product or hit you with their car? As one who was severely injured in a car crash 15 years ago, it's one of many things that changed in my life forever. However, the guy who hit me was from Mexico, so I didn't get any compensation for anything. Including medical expenses.

We don't even know if he followed directions on the label, never mind being sincere in his claim - which sounds very far fetched.

We all have losses.

I'm sorry about your situation, however. A car crash can muck about with the spine... amongst other, proven, possibilities. Never mind the jerk not having insurance, et al. :( (the same happened to me except the cretin who hit me was a 60 year old smoker with no insurance and expired license... the cop told me to leave before he wrote up his tickets. I was not belligerent in any way... though given how nervous I looked, he may have feared I would have gotten angry. When I did find out about the *****, I got very angry. )

If the user had followed the instructions, there wouldn't be an injury to sue over.

And honestly, a warning shouldn't even be needed because common sense should tell you to adequately ventilate a room when you are using an aerosol. I think everything at Home Depot should come with the warning label. "If you have no idea what you are doing, don't use this product."

and it injured him and caused him that kind of suffering, then I think it's reasonable to sue over it. Though $111 million? That's silly.

Manufacturers are crazy about putting every little detail on labels now. Do not use hair dryer while sleeping, etc...

That product is grade-A nasty-ass shit, folks. If you do not have sufficient ventilation (removing all the windows from your house is a start) when you spray this sealer, it will fuck you up.

Listen close to Hippie Jim the Product Safety Man: If you are using a product and you start to feel not so good, put the shit down and go the fuck outside. Right now. Do NOT, under any circumstances, finish the job before you get fresh air.
