Abu Ghraib Photo Release Appealed by Govt.
The Department of Defense lawyers notified the court yesterday of their intent to appeal to UNITED STATES COURT OF APPEALS FOR THE SECOND CIRCUIT. The ACLU indicated that it would be unusual for a FOIA lawsuit to go beyond the Appeals court so that the final decision should made by a panel of judges to be selected.

They will exhaust every possible dodge, and may eventually just refuse to comply.

2. This is the third time the gov has simply turned around
at the very lsst minute and started a new legal maneuver to avoid compliance.

The ACLU is being ridiculously fair minded and patient in their statements.

They will take this to the USSC. Losing there (if they lose) they will find some new bullshit excuse and go to a different low level judge, just like they did last time, and push a new case for why they cannot confess to rape torture and murder.

5. they can drag it out for a while,
but obviously the LAW is on our side, we just have to be patient.

Although hoping for these images to be released is unsettling, as the content is so gross, the american people deserve to know the truth.

6. nope. the supreme court can sidestep the issue
if it gets that far.

or they can rule in the interests of national security. Or they can just rule once and say that their ruling may not be used as precedent, like they did in 2000 when they first set the precedent of no-precedent rulings.

7. or they can rule on very narrow grounds -
thus avoiding responsibility and leaving the door wide open for the criminals occupying the white house to find another excuse to take to a different judge and start the whole show all over again.

8. Appeals, lawyers, more appeals, periods of discovery, depositions...
and that's why I did not go to law school.

Sometimes, in my darker moments, I just think it would be easier if we had a liberal dictator in this country whose word would be law.
