in a column, that there might not be any indictments.

19. Hmm. He didn't. Maybe Fitzgerald's website, which wasn't up when

Dean wrote that column, as was pointed out here in the topic about the column -- and Fitzgerald's meeting with Rove's lawyer the other day -- made Dean think at least one indictment is likely.

5. He is hinting

(rather strongly) that the White House is going to attempt a "national security" defense. Potentially very dangerous to democracy. It is, as he knows, what Nixon wanted to do during Watergate.

It used to work, but I don't think people believe them anymore--the White House I mean.

Won't they have to offer some evidence for that defense to work anyway?

20. It's a gamble

at best. Bush needs everyone indicted to quit. That includes, of course, anyone listed as an unindicted co-conspirator. Even Matthews pointed out Bush needs to be proactive tomorrow, and fire them. If he doesn't, he is invested in their defense. But the neocons are relying on Bush's natural stupidity and stubborn streak. They will sacrifice the host to promote the parasite's ability to survive.

The problem for them is that they do not want to make things public. They are relying upon federal courts to say they do not have to release information. The chances of this carrying the day seem remote. The more they struggle, the better it becomes.

However, this is a dangerous renegade, criminal cabal that has done crimes against humanity in Iraq, and blatant civil and constitutional violations here.

He had just been on the Mike Webb show 2 nights before and he returned to his initial view that Judge Hogan's OKing throwing Miller in jail indicated that something really big was brewing....

Also, he discussed in detail the conspiracy statute and all the ways it could be used.

In his article, his caveat is "unless...." and we all know that the "unless's" are pretty damn big....He was teasing in that article....

If they thought they were protecting national security, they may not be guilty of anything. Also "there's no black letter law" on the subject. I'm afraid that this will be the defense and that Fitz is taking so long to file because he wants an air tight case and doesn't have on yet. (Trying to remain optimistic, but...)

protecting national security? Isn't is an odd response to then out a covert CIA agent working on counterproliferation? And to immediately follow with outing a brass plate CIA propietary company working on the same thing? I anxiously await your answer.

When Prosecutor Paul McNulty announced the indictments in the Franklin case last August, he specifically stated that communication of classified information is a crime regardless of the motive.
