Rehnquist is retiring and after an initial outrage over Bolton it will be judicial nominations all the time for the rest of the year.

6. Bolton is a done deal. Either the Senate confirms, or he gets a recess
appointment. The Democrats are backed into a corner by the main stream media now, they let Bolton be confirmed and appear as caving in to Bush or they are portrayed as obstructionist.
I think they should force a recess appointment and wait for the truth about Bolton's record to come out. That way we can get some leverage for preventing future radical nominees by this corrupt administration.

The President shall have Power to fill up all Vacancies that may happen during the Recess of the Senate, by granting Commissions which shall expire at the End of their next Session.

- U.S. Constitution Article II, Section 2, Clause 3.

The U.N. ambasador vacancy happened when Senate was in session, not during a recess. Thus Bolton cannot get a recess appointment, unless you guys see something that I do not.

15. Seems simple enough, doesn't it. However, it all depends upon,...
,...how you interpret "vacancies that happen during". Is the question whether the UN vacancy actually occured during a recess? OR is the question whether the appointment to fill the vacancy occured during a recess? OR is the question whether a vacancy is still a vacancy during the recess?

Ya' see, the RW extremists are good at manipulating, playing hocus pocus with the law.

Common sense would be the day the vacancy occured. However, those who seek to break the law without appearing to do so will come up with all kinds of creative bullshit.
