1. I think it would be tactically wise to refuse

GOP: We'll investigate DeLay if you quit making noise about us changing the ethics rules. By the way, we're still not changing the ethics rules, just making an exception.

DEMS: No deal. Change the rules back and investigate DeLay anyway.

This sort of a move would clearly show anyone paying attention that the Republicans are refusing to investigate DeLay for purely politcal reasons. We already knew that, but still...
