Elephant in the Room - Could Saddam Go Free??
If it is determined that the intelligence used to find Saddam Huseein was gathered via one of the abuse/torture victims at Abu Ghraib, could his case then be thrown out?

I haven't seen anyone bring this up yet.

1. Good point, that certainly would be due process...
...under the Constitution of the United States, but BushCo has rendered that document temporarily suspended. Don't count on any such arguments to make it into the trials of Saddam.

4. There 0% chance
That Saddam will be tried under our constitution anyway. Even if Kerry or Dean were in the white house right now; it will be under Iraqi law (if and when it gets set up).

But that's pretty unlikely in my mind. There's no lack of evidence that Saddam was a bad guy; they wouldn't need to torture it out of prisoners. So it would be pretty incompetent of the Bush Administration to let their case fall apart on that account.

Still, this administrations skill at incompatence has surprised me before; maybe they can do it again.

5. No, Hussein may be transferred to Iraqi custody
but he will be tried by them eventually. There is no chance he goes free whatsoever.

6. Constitutional rights only apply to US citizens and residents. Saddam, if
he lives to be tried, will probably be subjected to the type of due process he is more accustomed to.

9. i think this kangaroo court
has already decided on the verdict. yeah his case could be thrown out if it were in the U.S., but it ain't. they'll make up a special court with rules that only apply to his case, so the only evidence thrown out will be the politically sensitive defense evidence showing BFEE collaboration.

13. yeah . . . release him on a techincality, set him up with a nice place . .
to live in some out-of-the-way location, and hire him as a consultant to the U.S. military in Iraq . . . yeah, that's the ticket . . . might as well pile on a little more absurdity . . .
