SAN FRANCISCO (Reuters)A U.S. appeals court gave Wal-Mart Stores Inc. permission on Friday to appeal a judge's decision to let a record-sized sex discrimination lawsuit proceed against the retailer as a class action.
In June, a federal judge in San Francisco said a lawsuit that charges Wal-Mart discriminated against women in pay, promotions and training can proceed as a class action. Plaintiffs' lawyers called it the largest civil rights class-action case in U.S. history.
The 9th Circuit Court of Appeals ruled on Friday that Wal-Mart could appeal the June 22 decision of U.S. District Court Judge Martin Jenkins.
"The court, in its discretion, grants the petition for permission to appeal the district court's June 22, 2004, order granting class action certification," a 9th circuit panel of three judges wrote.
The order gave Wal-Mart, the world's largest retailer, 10 days to perfect its appeal and asked for the court clerk to expedite a hearing after that. ..
