Libya rejects ICC arrest warrant for Muammar Gaddafi

Libya has rejected a warrant issued by the International Criminal Court
for the arrest of Col Muammar Gaddafi, saying the tribunal has no authority.

3. Indeed. I'm glad most of the rest of the world recognizes the ICC.
"As of June 2011, 114 states are members of the court, including all of South America, nearly all of Europe and roughly half the countries in Africa." The entire Western Hemisphere, except for the US, are members of the court.


The States Parties to the ICC (in green) and the signatories to the Rome Statute (in orange).

"...34 countries, including Russia, have signed but not ratified the Rome Statute; one of them, Côte d'Ivoire, has accepted the Court's jurisdiction. The law of treaties obliges these states to refrain from “acts which would defeat the object and purpose” of the treaty. Three of these states—Israel, Sudan and the United States—have "unsigned" the Rome Statute, indicating that they no longer intend to become states parties and, as such, they have no legal obligations arising from their former representatives' signature of the statute. 43 United Nations member states have neither signed nor ratified or acceded to the Rome Statute; some of them, including China and India, are critical of the court."

6. Note that Libya has not signed either. Gaddafi got a warrent issued due to a UNSC referral.

My fantasy is that we get a President who is brave who sits down, tells the UNSC to go after Bush, and then vows not to veto it. It'd happen in a heart beat.

only third world dictators that refuse to hand over their oil and other natural resources are wanted.

7. Only exempt because we have a cowardly leadership.
There's no "technical exemption." As I said up thread, Bush could be referred via the UNSC. But if anyone tried it the US would obviously veto. So it would take a brave administration to say "we don't want this vetoed," and pow, there goes the referral and the likely arrest and trial of Bush.
