Judge rules against gay students in Lubbock
LUBBOCK - A federal judge today ruled against a group of gay high school students who sued the Lubbock school district after they were prohibited from meeting on campus.

The Lubbock Gay Straight Alliance claimed in its July lawsuit that the district violated students' constitutional rights and a law forbidding discrimination against groups meeting on campuses of schools receiving federal funds.

(This judge is a rogue Reagan appointee. This issue has been decided again and again--districts cannot block access to these groups. I guess it will have to go to the Supreme Court. They will rule that gay student groups must be allowed. The law is called the Equal Access Act and the Christian right pushed it so that Christian student groups would have access to campuses. It also applies to gay student groups.)

2. This is extreme "activism" if there ever were such a thing.
This is blatantly against the law. While the judges the right is complaining about sometimes throw out statutory law they interpret as infringing on rights protected by the constitution, this judge is RESTRICTING rights on the basis of so-called "community standards" when there is no provision in law--statutory or otherwise--to do so.

I'll tell you what's obscene - using one's position as a judge to legislate morality from the bench, with no legal right to do so, while perverting one's Constitutional oath by restricting freedom of association.
