Secrecy order in CIA leak case challenged by media
A major U.S. media organization on Monday challenged efforts by special counsel Patrick Fitzgerald to keep documents secret in the CIA leak case that involved the Bush administration.

Dow Jones & Co, which publishes The Wall Street Journal and other publications, filed court papers asking Judge Reggie Walton to deny a sweeping motion by Fitzgerald that would bar public disclosure of documents in the case.

The proposed protective order, which was agreed to by Vice President Dick Cheney's chief of staff, Lewis "Scooter" Libby, would cover grand jury transcripts, witness statements and a wide range of other documents involved in the case. Any leaks could result in civil and criminal fines, the order warns.

"Dow Jones has a substantial interest in ensuring timely access to information of importance to its readers and the general public," Dow Jones said in its motion. "That interest is particularly strong in a case like this one, which concerns a matter of great national importance."

Tonight on Olbermann, John Dean, former Nixon legal counsel before and up to Watergate, said he read through Fitz transcript carefully and Fitz included references to Espionage Law. Dean says Fitz wouldn't have done that if he didn't plan to pursue the course of finding the leak source under that law. Dean also said the length of indictment is highly unusual and it's remarkably thorough. Talk of Libby lies and if he's falling on the sword about to cop a plea? Libby's a firewall and Fitz could not break through beyond his lies, Dean surmises. Also talk about the WH barring the door for a long time unless Congress changes to majority Dems in '06.

Chuckle that Cheney's health could worsen if Dems take over Congress in '06.

The prosecutor in the CIA leak case has sparked another fight with the news media, this time over access to material that prosecutors will turn over to attorneys for I. Lewis "Scooter" Libby.

Special Counsel Patrick J. Fitzgerald is seeking a protective court order that would bar Libby and his legal team from publicly disclosing "all materials produced by the government."

Dow Jones & Co., the publisher of the Wall Street Journal, went to court yesterday to fight the proposal.

"As the Supreme Court has recognized," Dow Jones said in court papers, " 'The criminal justice system exists in a larger context of a government ultimately of the people, who wish to be informed about happenings in the criminal justice system.' "

U.S. District Judge Reggie B. Walton has not yet ruled....
