WEST PALM BEACH -- Rush Limbaugh's attorney urged a judge Tuesday to limit the medical records that prosecutors can review for their investigation into whether the best-selling commentator illegally purchased painkillers.

Attorney Roy Black said the records, which were seized in 2003, should be reviewed by a judge before they are opened to prosecutors. ``We're talking about privacy matters and privileged matters,'' Black told the judge, saying prosecutors should not see ``things that have nothing do to with the items that they are investigating.''

Limbaugh had hoped to keep his records closed to prosecutors entirely, but he lost at the Circuit Court and appellate court levels. The Florida Supreme Court declined to hear the case.

Prosecutors seized the records after learning that Limbaugh received about 2,000 painkillers, prescribed by four doctors in six months, at a pharmacy near his Palm Beach mansion. They contend that Limbaugh engaged in ``doctor shopping,'' or illegally deceived multiple doctors to receive overlapping prescriptions.

28. I think what is in those records is this:
No back surgery, doctors' notes with clear lies from Limbaugh, and clear evidence of doctor shopping. Hence their request to only consider ILLEGAL drug purchasing. That would not be in the medical records. It's total BS and the judge is not going to fall for it.

How come we never hear anymore about him buying these pills out of the trunk of some car at the local Denney's? I mean that is how this whole thing came to light isn't it? I don't think the pharmacies turned him in. Wasn't there some woman who wore a wire and sold him large quantities of drugs out of a car?

Funny! IF it were you or me, we would be in jail by now.

Wasn't he pushing to get Kerry to sign his SF-180? Wasn't he calling for the release of Bill Clinton's Medical Records so we could read about the "distinct" curve of the 'clenis'"?

That "anyone else" would be in jail by now, but we all know that famous or wealthy people, regardless of their political affiliation never go to jail for this kind of shit. Famous people have to actually get caught red-handed at least 5 times (see Robert Downey Jr.) before they even get the token "30 days". I'm not saying that it's right, but that's how it is.

and Noelle did. This guy was featured on Nightline a couple of weeks ago.

Here's a bit of legal information that may interest Rush Limbaugh: Under Florida law, illegally obtaining more than 28 grams of painkillers containing the narcotic oxycodone—a threshold exceeded by a single 60-pill Percocet prescription—automatically makes you the worst sort of drug trafficker, even if you never sold a single pill. Even if, like Richard Paey, you were using the drugs to relieve severe chronic pain.

Although prosecutors admitted Paey was not a drug trafficker, on April 16 he received a mandatory minimum sentence of 25 years for drug trafficking. That jaw-dropping outcome illustrates two sadly familiar side effects of the war on drugs: the injustice caused by mandatory minimum sentences and the suffering caused by the government's interference with pain treatment.

Paey, a 45-year-old father of three, is disabled as a result of a 1985 car accident, failed back surgery, and multiple sclerosis. Today, as he sits in jail in his wheelchair, a subdermal pump delivers a steady, programmed dose of morphine to his spine. But for years he treated his pain with Percocet, Lortab (a painkiller containing the narcotic hydrocodone), and Valium prescribed by his doctor in New Jersey, Steven Nurkiewicz.

Unable to find a local physician who was comfortable taking him on as a patient, Paey used undated prescription forms from Nurkiewicz's office to obtain painkillers in Florida. Paey says Nurkiewicz authorized these prescriptions, which the doctor (who could face legal trouble of his own) denies.

With permission from the 4th District Court of Appeal, the ACLU, a liberal advocate of constitutional rights, will file an amicus curiae - or friend of the court - brief to help Limbaugh, who is under investigation in Palm Beach County for alleged drug prescription fraud. The ACLU contends that unsealing Limbaugh's records would be an unconstitutional invasion of privacy. So does Limbaugh, who is appealing Palm Beach County Circuit Judge Jeffrey Winikoff's decision to allow state prosecutors to review the records, seized Nov. 25 with court-approved search warrants.

In his book, See, I Told You So, Limbaugh provides a list of words in a chapter titled "Politically Correct Liberal Lexicon." For the ACLU, he writes, "official guarantor of all constitutional rights." That's followed by, "Acquittal: What ACLU tries to get in all criminal cases."

In 1995, Limbaugh and the ACLU squared off in federal court when a radio network wanted to run a parody of Limbaugh's program called After the Rush. Limbaugh's producers sued for $15 million to keep the show from using "Rush" in the title. The ACLU sided with the network, claiming it was a free speech issue. Limbaugh's lawsuit was dismissed.

Black told the Miami Herald the seized records contain embarrassing details about surgery performed on intimate parts of Limbaugh's anatomy that are unrelated to the case.

The argument followed the Florida Supreme Court's April rejection of Limbaugh's appeal to keep the records sealed.

Most of us would've served our time already. One technicality and appeal after another. They are micromanaging the process and escaping scrutiny of the facts thus far. Granted, they are losing many of the battles, but they could win the war in wearing down the prosecution until they say UNCLE and cut a deal. That's where this is going.

We got pictures of the one they took from my hubby, a "mushroom" type that if left alone, would likely morph into a cancerous one within 5-10 years, and believe me, he was glad to see it gone! Found during a routine, "I am over 40 exam"...so the exams do catch things...get them done if you can.

So what type of surgery on intimate parts could be construed to be embarrassing for a man? I can only speak from a womans point of view, but maybe breast reduction surgery? Guys..help me out.

As a woman who has given birth, not too much in the way of surgery would be embarrassing for me, maybe a third nipple would have been weird, but in our household, it would have been dream comedic material, something we could all, including the affected person, have a laugh about at an unexpected moment.
