That makes no sense. The separation of troops under DADT takes place under the guidance of executive policy.

10 USC §654 (b) Policy.— A member of the armed forces shall be separated from the armed forces under regulations prescribed by the Secretary of Defense if one or more of the following findings is made and approved in accordance with procedures set forth in such regulations:

The Secretary of Defense reports to the Commander in Chief— the President. If the President wants to set an EO for the Sec. of Defense to re-formulate the "regulations" he prescribes... then the terms of separation can become whatever the President wants them to be, regardless of DADT.

The President just needs to have the cajones to face the vitriol that FOX News would generate.

I'm curious to hear how you see the EO power of the President on the subject having been "taken away decades ago"?
