You aren't suppose to be able to sue solely on speculative grounds.

A judge should dismiss a case in which the petitioner doesn't even make the argument as to how/why/where Mrs. Stacks was aware of the attack.

A judge should dismiss is EXACTLY for the reasons you indicate. She may NOT be negligent and could be found civilly liable for something that is not her responsibility.

The complaint indicate solely that (my paraphrasing) she should have know because she went to a hotel.

If that is all you got then the complaint is without merit. She is trying to go fishing (hoping to win without merit) and the judge has a responsibility to not let that happen.
