Time machines where the past can be changed assume multiple timelines. Thus, you could be prosecuted for murder in your timeline, but not the other where the person did not exist.

However, two situations arise: one, where even though you caused the person not to be born, you would return to your original timeline where the person would still exist. Your effort would feel very futile.

OR

Where there is but one timeline, your prevention of their birth would mean you never knew them and would be unable to go back in time to prevent their birth. Which would cause them to be born which would cause you to go back in time etc etc etc, at which point the universe, in disgust, would erase you from the timeline, because the universe does not allow paradoxes. In fact, you would not ever have existed to be erased.
