and then he grabbed her started sucking on her neck. IMO, the initial kiss may have been inapropriate, and ill advised, but not criminal.

Its his actions afterward that constituted the assault. But I guess just calling it a kiss is a way for him to minimize his crime.

IMO, the neighbor walking in saved this lady from being raped.

justice served imo.
