73. My letter to the good Senator
Senator Byrd:

Although I am not your constituent, I have long admired your viewpoints. Your knowledge of the Constitution of the United States is second to none in the Senate, and your defense of it has been most eloquent in an age of inelegant discourse.

As such, I hope you can understand my bewilderment of your supporting Sam Alito to the highest court in the land. Judge Alito's support of the Unitary Executive theory represents the greatest threat to the Republic in modern times. In short, the White House and Judge Alito believe the Constitution implies the Executive branch can act at will during times of war, even to the point of violating other Constitutional rights. Senator Byrd, call the Unitary Executive theory what it is: Bush is trying to justify unchecked dictatorial powers with no sunset provision during a phony war. Do you not see that our Republic now teeters on the edge of dictatorship? Do you want to be responsible for enabling George W. Bush to shatter the rule of law?

I urge you to reverse your support for Judge Alito. Your reconsideration may make matters difficult with re-election, but if there is anyone who can explain why you withdrew your support from Judge Alito and his threat to our country and Constitution, it surely is you. What good is re-election if you no longer recognize the country you live in once Judge Alito is on the Supreme Court and George W. Bush is above the law?

Stand for the United States. Stand for the Constitution. But above all, Senator Byrd, stand for We, the People who live in this great land and abide by its laws.
